LII.

II. Be it enacted, by the General Affembly of Maryland, That the commiffi-
oners of Baltimore-town, or a major part of them, fhall be and they are hereby
authorifed and empowered, at any time in the year, as well as between the firft
and laft day of November yearly, during the continuance of the act to which this
is a fupplement, to nominate, appoint and licence, any number of perfons, not
exceeding five, of good repute and fkill, to be weighers of all hay brought to and
fold within the faid town,

C H A P. LIII.
An ACT to regulate and difcipline the militia of this ftate.

WHEREAS the congrefs of the United States, by their ad, entitled,
An act more effectually to provide for the national defence, by
eftablifhing an uniform militia throughout the United States, have
enacted as follows, to wit: "Be it enacted, by the fenate and houfe of repre-
fentatives of the United States of America in congrefs affembled, That each and
every free able-bodied white male citizen of the refpective ftates, refident therein,
who is or fhall be of the age of eighteen years, and under the age of forty-five
years, (except as is herein after excepted,) fhall feverally and refpectively be en-
rolled in the militia, by the captain or commanding officer of the company with-
in whofe bounds fuch citizen fhall refide, and that within twelve months after
the paffing of this ad. And it fhall at all times hereafter be the duty of every
fuch captain or commanding officer of a company, to enrol every fuch citizen as
aforefaid, and alfo thofe who fhall, from time to time, arrive at the age of
eighteen years, or being of the age of eighteen years and under the age of forty-
five years, (except as before excepted,) fhall come to refide within His bounds ;
and fhall, without delay, notify fuch citizen of the faid enrolment, by a proper
non-commiffioned officer of the company, by whom fuch notice may be proved.
That every citizen fo enrolled and notified, fhall, within fix months thereafter,
provide himfelf with a good mufket or firelock, a fufficient bayonet and belt, two
fpare flints, and a knapfack; a pouch with a box therein, to contain not lefs
than twenty-four cartridges fuited to the bore of his mufket or firelock, each
cartridge to contain a proper quantity of powder and ball; or with a good rifle,
knapfack, fhot-pouch and powder-horn, twenty balls fuited to the bore of his
rifle, and a quarter of a pound of powders and fhall appear fo armed, accoutred
and provided, when called out to exercife or into fervice, except that when called
out on company days to exercife only, he may appear without a knapfack. That
the commiffioned officers fhall feverally be armed with a fword or hanger, and
efpontoon; and that from and after five years from the paffing of this act, all
mufkets for arming the militia as herein required, fhall be of bores fufficient for
balls of the eighteenth part of a pound; and every citizen fo enrolled, and pro-
viding himfelf with the arms, ammunition and accoutrements, required as afore-
faid, fhall hold the fame exempted from all fuits, diftreffes, executions or fales,
for debt, or for the payment of taxes. And be it further enacted, That the
vice-prefident of the United States, the officers, judicial and executive, of the
government of the United States, the members of both houfes of congrefs, and
their refpective officers, all cuftom-houfe officers, with their clerks, all poft-of-
ficers, and ftage drivers who are employed in the care and conveyance of the
mail of the poft-office of the United States, all ferrymen employed at any ferry
on the poft-road, all infpectors of exports, all pilots, all mariners actually em-
ployed in the fea fervice of any citizen or merchant within the United States,
and all perfons who now are or may hereafter be exempted by the laws of the
refpective ftates, fhall be and are hereby exempted from militia duty, notwith-
ftanding their being above the age of eighteen, and under the age of forty-five
years. And be it further enacted, That within one year after the paffing of this
ad, the militia of the refpective ftates fhall be arranged into divifions, brigades,
regiments, battalions and companies, as the legiflature of each ftate fhall direct;
and each divifion, brigade and regiment, fhall be numbered at the formation,
thereof, and a record made of fuch numbers in the adjutant-general's office in
