therein, and make compenfation for the injury, if any, which may have been
fuftained by any inhabitant of the faid town, to be afcertained by any two difin-
terefted perfons, inhabitants as aforefaid, and fhall not pay for every fuch Sheep
or fwine the fum of one fhilling for every day it fhall have been fo impounded, it
may be lawful for the perfon or perfons fo impounding as aforefaid to fell or kill
the fame for his, her, or their ufe and benefit.

III. And be it enacted, That if any perfon or perfons fhall be fued and implead-
td for killing, destroying or felling, any fuch fheep or fwine as aforefaid, the de-
fendant or defendants may plead the general iffue, and give this act and the Spe-
cial matter in evidence; and if the plaintiff fhall be nonfuit, or difcontinue his
fuit, he fhall pay cofts, and fuch damages to the defendant or defendants as the
court fhall adjudge.

C H A P. VI.

An ACT concerning Temple-ftreet, in Baltimore-town, in Bal-

timore county.

WHEREAS it has been reprefented to this general affembly, by the pe-
tition of the owners of lots on Temple-ftreet, and others, in Balti-
more-town aforefaid, that that part of Temple-ftreet which is fitu-
ated on the north fide of Pitt-Streer, in Baltimore-town, is unnecessary, and
does not contribute in any degree to the convenience or accommodation of the in-
habitants of the faid town, but on the contrary, that it is highly injurious and
inconvenient to the proprietors of the lots fituate thereon, and praying that the
faid part of Temple-ftreet might be ftopped up, and be no more a public ftreet
of the faid town; and the prayer of the faid petitioners appearing reafonable,

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That that part of
Temple-ftreet aforefaid, which is Situated on the north fide of Pitt-ftreet, in the
town aforefaid, fhall not from henceforth be or remain a part of Temple-ftreet
aforefaid, and that the owners and proprietors of the ground thereof fhall have
;the Same right and benefit to the fame as if the fame had not been laid out as a
part of Temple-Street aforefaid, and may enclofe the fame accordingly, any law
to the contrary notwithstanding.

C H A P. VII.

An ACT to eftablifh the road from the Turkey Foot road towards
Bradock's road as a public road, and for other purpofes therein
mentioned.

WHEREAS Sundry inhabitants of Allegany county, by their petition to
this general affembly have fet forth, that there hath been a road from
the Turkey Foot road, above the fork of Jenning's Run, leading up
the faid run by Ofwalt's faw-mill to the foot of Mount-Pleafant, and from
thence until it interfects Bradock's road at a tract of land called The Mountain,
and that, it never having been made a public road by law, they are deprived of
the benefit and utility of the fame, to their great injury and inconvenience, by
its not being eftablifhed a public road as aforefaid; and the prayer of the faid pe-
titioners appearing to this general affembly to be reafonable,

II. Be it enacted, by the General Affembly of Maryland, That the aforefaid
road leading from the Turkey Foot road by the aforefaid places until it interfects
Bradock's road at the faid trad of land called The Mountain, be and the fame is
hereby declared, deemed and taken to be, a public road for ever, any law to the
contrary in anywife notwithstanding.

III. And be it enacted, That Michael Ofwalt, Garret Snedeker, fenior, and
Edward Grimes, or any two of them, be and are hereby appointed commiffioners
on the aforefaid road, and that they, or any two of them, are hereby authorifed
and empowered to lay out, mark and bound, the fame, not more than thirty feet
