pealed, and fo much of the act of affembly, entitled, An act for eftablifhing a
company for opening and extending the navigation of the river Patowmack, as
directed the fale of the fhares of delinquent fubfcribers, fhall be and remain in
full force and effect.

CHAP,
XXIX.

III. And be it further enacted, That the time for completing the navigation
of Patowmack River be and is hereby further extended until the firft day of
January, feventeen hundred and ninety-eight, and that no privilege or advantage
granted by law fhall be forfeited or loft in cafe the navigation aforefaid fhall be
finifhed within the time hereby limitted, any thing in any act to the contrary not-
withftanding.

IV. And be it further enacted, That the feveral tolls made payable by the act
of the general affembly, entitled, An act for eftablifliing a company for opening
and extending the navigation of the river Patowmack, fhall inftead thereof be
payable at Hook's Falls, and the tolls by faid act made payable at the Great
Falls, fhall be payable at the Great Falls and at Watt's Branch, in fuch pro-
portion as fhall be directed by the prefident and directors of the Patowmack
Company, and that the tolls by the faid act made payable at the mouth of the
South Branch, fhall be and are hereby made payable at fome convenient place
between the mouths of Great Cacapeton and Conococheaque, to be appointed
by, the prefident and directors of the Patowmack Company, any thing in any
former act or ads of affembly to the contrary notwithftanding.

CHAP. XXX.
A Further fupplement to an act refpecting the fettlers on the re-
ierved lands weftward of Fort Cumberland.
WHEREAS by an act of November feffion, feventeen hundred and
ninety-two, the fettlers were authorifed to pay one third of the ba-
lances due this ftate on or before the firft day of May, feventeen
hundred and ninety-three, one third on or before the firft day of May, feven-
teen hundred and ninety-four, and the remaining third on or before the firft day
of May, feventeen hundred and ninety-five: And whereas at the paffage of faid
law a number of the lots weftward of Fort Cumberland were proclamated, but
for the ufe of the original fettlers, who were precluded from the benefit of the
faid law: And whereas by the act of November feffion, feventeen hundred and
ninety-three, the treaiurer was authorifed to receive the one half of the balances
due from the faid fettlers to this ftate on or before the firft day of May, feventeen
hundred and ninety-four, and the remaining half on or before the firft day of
May, feventeen hundred and ninety-five, provided it appeared by an endorfement
on the faid warrants they were affigned to the original fettler: And whereas the
fettlers apprehending the treafurer, by the faid laft recited act, was authorifed to
receive the one half of the balances due from them at any time before the pro-
clamation warrants were out of date, omitted to pay the fame on the firft day of
May laft, but made a tender thereof before the faid warrants were out of date,
when the treafurer would not receive it: And whereas in confequence thereof
they again were obliged to proclamate the lots returned to them; and it appear-
ing reafonable to this general affembly to allow to the faid perfons the benefit of
the payments they have made; therefore,

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That the treafurer of
the weftern fhore fhall and he is hereby directed, in all cafes where warrants
of proclamation have iffued to affed any land of the defcription aforefaid, to re-
ceive the balance due this ftate for any of the faid lands at any time before the
operation of the faid warrants fhall ceafe, provided it fhall appear, by an endorfe-
ment on the faid warrant or warrants, that the fame is or are affigned to the ori-
ginal fettler; and alfo to receive, from any of the faid fettlers whole lands are not
proclamated, the balance due this ftate for the fame, at any time before the fame
fhall be proclamated,
