LXXXVI.

before-mentioned Sarah Buchanan, who hath fince intermarried with a certain

Robert Turnbull, of the commonwealth of Virginia: And whereas by a fup-
plement to the faid act, the aforefaid Thomas Sim Lee was authorifed to execute
and acknowledge to the purchafer or purchafers of the faid lands, on the pur-
chafe money for the faid property fo fold being paid, a deed or deeds, conveying
the faid property to the faid purchafer or purchafers in fee: And whereas the faid
Thomas Sim Lee hath declined to execute a deed to one of the purchafers of the
faid lands, who had paid the whole of the purchafe money for the lands by him
purchafed, and it being requifite that when the purchafe money is paid, fome
perfon fhould be authorifed and empowered to execute deeds for the faid lands,

II. Be it enacted, by the General Affembly of Maryland, That the chancellor
of the ftate for the time being be and he is hereby authorifed and empowered, on
the purchafe money for the faid property fo fold being paid, to execute and ac-
knowledge to the purchafer or purchafers of the fame a deed or deeds, conveying
the faid property to the faid purchafer or purchafers in fee, which deed or deeds,
fo executed and acknowledged, fhall be as good and effectual in law as if the
faid deed or deeds had been executed by any three or more of the truftees in the
act aforefaid mentioned, any thing in. the law to which this is a further fupple-
ment, and the fupplement thereto, to the contrary notwithftanding.

C H A P. LXXXVII.
An ACT for the direction of fheriffs and coroners in the return
of jurors; and for the better regulation of juries.

WHEREAS the integrity, experience and intelligence of jurors, is in-
difpenfably neceffary for the due adminiftration of juftice: And
whereas the fheriffs frequently return jurors very inadequate to the
difcharge of the important duties affigned to them;

II. Be it enacted, by the General Affembly of Maryland, That all fheriffs and
coroners within this ftate already commiffioned, fhall, on or before the firft
Monday in March next, take the following oath, or affirmation, (as the cafe
may be,) before fome judge or juftice of the court of the county for which they
may have bee a refpectively commiffioned, to wit: "I, A. B. do fwear, or af-
" firm, (as the cafe may be,) that in fummoning jurors to be returned to any of
" the courts of this ftate, and that in executing every writ or precept which
" fhall come to my hands for the return of jurors, I will ufe my utmoft diligence
" to fummon and return, as jurors, fober and judicious perfons, of good reputa-
" tion, and qualified by the laws of this ftate to ferve as jurors, and to prevent
" any man being fummoned or returned by me, or by any officer under me, who
" in my judgment will be influenced in determining any of the matters which
" fhall come before him as a juror by hatred, malice or ill will, fear, favour or
" affection, or by any partiality whatever; and that I will not fummon or re-
" turn as a juror any perfon who, in my opinion or to my knowledge, may be
" folicitous to be returned upon the pannel of jurors;" and that they refpec-
tively return a certificate of fuch oath, or affirmation, to the clerk of the court
of the county for which fuch perfon is commiffioned as fheriff, or coroner, with-
in twenty days thereafter, there to be recorded by faid clerk, whofe duty it is
hereby declared to be to record the fame amongft the proceedings of the preceding
county court, and that in cafe any fheriff or coroner fhall neglect to take fuch
oath, or affirmation, or return a certificate thereof as aforefaid, the perfon fo
neglecting fhall forfeit and pay the fum of fifty dollars, to be recovered by in-
dictment before the diftrict court of the county for which fuch perfon is com-
miffioned, and applied to the ufe of faid county.

III. And be it enacted, That no perfon fhall be fummoned as a juror by any
fheriff or coroner of this ftate to two general or county courts fucceffively.

IV. And be it enacted, That every fheriff and coroner hereafter commiffioned
within this ftate fhall, before he be allowed to proceed on the execution of his
