1797.

VIII. And be it enacted, That the faid commiffioners, in their direction to
the affeffors by them be appointed in virtue of this act, fhall be governed in
all refpects by the provifions and directions of the act, entitled, An act to afcer-

tain the value of the land in the feveral counties of this ftate for the purpofe of
laying the public affeffment, paffed at November feffion, feventeen hundred and

eighty-five, and of this act; and the faid commiffioners fhall not be obliged to
alter the price or value let on any lands in virtue of the aforefaid act averaging
the value of lands, except fo much of the federal city as lies in Prince-George's
county, which fhall be valued agreeably to its prefent worth, except on account
of improvements erected thereon fince the paffage of the faid act, and except alfo
in cafes where the value of the property has been diminifhed by fire, or other
unavoidable accident, and except alfo in cafes where, on an appeal by the party
interefted, and on examination, they fhall be of opinion the former valuation
was erroneous and unjuft; and the faid commiffioners are hereby authorifed to
call on the clerks of their counties to deliver them a lift of alienations from the
firft day of June, one thoufand feven hundred and ninety-feven, to the firft
meeting of the faid commiffioners, and fo from time to time as occafion may re-
quire, and alfo to call on the clerks of their counties for a lift of all transfers of
perfonal property which fhall be recorded in their refpective offices, and which
take place after the affeffment of property in virtue of this act, from time to
time as occafions may require.

IX. And be it enacted, That the twelfth, thirteenth, fourteenth and fifteenth
fections of the act, entitled, An act for the valuation of real and perfonal pro-
perty within this ftate, paffed at November feffion, one thoufand feven hundred
and ninety-two, be and the fame are hereby continued.

X. And be it enacted, That if any perfon appointed an affeffor in virtue of
this act, and who fhall accept of his faid appointment, fhall neglect to return to
the commiffioners certificates for fuch valuation of the real and perfonal property
in his diftrict, agreeably to this act, and the inftructions given to him, he fhall,
for every fuch neglect, forfeit a fum not exceeding fifty pounds current money;
and if any perfon appointed an affeffor fhall not appear at the time appointed, or
fhall appear and refute to ferve, the faid commiffioners, or a majority of them,
fhall appoint, by warrant under their hands, fome other perfon, qualified as
aforefaid, as an affeffor, in the room of the perfon fo making default, or refufing
to ferve; and if fuch perfon fhall alfo make default, or refufe to act, they may
proceed to a new appointment, in like manner, and as often as neceffary, until
the vacancy be fupplied; and if any affeffor fhall die, or be rendered incapable to
act, before he fhall have fully completed his valuation, the faid commiffioners
fhall, by warrant under their hands, nominate fome perfon, qualified as aforefaid,
to be affeffor in the room of the affeffor fo dying, or rendered incapable to act;
and the faid commiffioners, or a majority of them, fhall, immediately thereafter,
lend fuch warrant to the perfon fo nominated affeffor.

XI. And be it enacted, That the commiffioners herein before named and ap-
pointed for the city of Baltimore, or the major part of them, fhall meet at fome
convenient place in the faid city, to be appointed by them, at the feveral and re-
fpective times herein before mentioned and prefcribed for the meetings of the
commiffioners of the feveral counties; and the faid commiffioners for the city of
Baltimore, or the major part of them, fhall then and there execute the feveral
powers and duties committed to and required of the commiffioners of the fe-
veral counties by this act, and fhall be liable to the fame penalties for omiffions
neglect of duty as are impofed by this act on the commiffioners of the feveral
counties.

X. And be it enacted, That the commiffioners of the tax for the city of
Baltimore fhall meet, at fome convenient place in the faid city, at the time afore-
faid, or as foon thereafter as they may have notice of this act, and then and there
appoint a clerk, and one or more fenfible and active perfons, inhabitants of the
faid city, to be affeffor or affeffors of the real and perfonal property in the faid
