CHAPTER 906
(House Bill 963)

AN ACT to repeal and re-enact, with amendments, Section 109 of
Article 52 of the Annotated Code of Maryland (1960 Supplement),
title "Justices of the Peace", sub-title "Trial Magistrates System",
relating to the number of constables and their salary and expenses
in Allegany County.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 109 of the Annotated Code of Maryland (1960 Supple-
ment) , title "Justices of the Peace", sub-title "Trial Magistrates Sys-
tem", be and it is hereby repealed and re-enacted, with amendments,
to read as follows:

109.

One constable at large may be appointed by the county commis-
sioners of the several counties for each trial magistrate, and each of
said constables at large shall receive, in lieu of fees in civil and
criminal cases, an annual salary of $600.00; but in Allegany County,
the County Commissioners shall appoint [four] two constables at
large for the two trial magistrates who sit for the trial of cases in
the City of Cumberland; [one of said constables shall receive an an-
nual salary of not less than twenty-one hundred and sixty dollars
($2,160.00), one shall receive an annual salary of not less than
eighteen hundred dollars ($1,800.00), one shall receive an annual
salary of not less than fifteen hundred dollars ($1,500.00) in lieu in
each case of all criminal costs and fees, and one shall receive an annual
salary of twelve hundred dollars ($1,200.00) plus all fees and costs
allowed by law for all services performed by him in civil and criminal
cases] each of said constables shall receive an annual salary of not
less than Three Thousand Dollars ($3,000.00); and such mileage as
the county commissioners may allow,
and the County Commissioners
of Allegany County may increase the compensation of said constables
or appoint additional constables at large for trial magistrate in said
county and provide for the compensation of such constables either by
the fees prescribed by law or by such annual salary in lieu of fees,
as the County Commissioners, in their discretion, may determine;
provided, however, that the provisions of this section shall not apply
to the counties of Carroll, Frederick, Montgomery, Wicomico, Prince
George's, Harford, Cecil and Calvert, and in Anne Arundel the
County Commissioners may appoint two constables at salaries of not
more than twelve hundred dollars ($1,200.00) per year.

Sec. 2. And be it further enacted, That this Act shall take effect
June 1, 1961.
