THEIR GOOD OFFICES TO STUDY CONDITIONS IN THIS IN-
DUSTRY AND IMPLEMENT A PROGRAM TO ALLEVIATE THE
PRESENT DEPRESSED CONDITION; AND BE IT FURTHER

Resolved, That the Secretary of State send copies of this Resolu-
tion to the President of the United States, the Secretary of Com-
merce, the Chairman of the Federal Maritime Board, the Commis-
sioner of the Bureau of Customs, and each Maryland Representative
and Senator in the United States Congress.

(House Joint Resolution 34)

House Joint Resolution requesting the Legislative Council to study
the present limitations upon the payment of overtime to certain
supervisory State employees.

Whereas, The present law, Article 100, Section 76, provides for
the payment to certain State employees of extra compensation for
hours worked in excess of forty hours in any week; and

Whereas, Said law provides that department heads with the ap-
proval of the Commissioner of Personnel are authorized and em-
powered to designate "those bona fide supervisory employees who
actually exercise supervisory control over a major function within
the respective departments * * * * who shall not be subject to the
provisions of a forty hour week"; and

Whereas, The members of the General Assembly of Maryland are
advised that in many instances employees are designated as ex-
ercising "supervisory control over a major function" and thus not
entitled to overtime because of a very broad interpretation of the
last quoted phrase; and

Whereas, It is the wish of the General Assembly of Maryland to
make certain that the aforesaid statute is being properly and fairly
administered and interpreted as said statute is now drawn; now,
therefore, be it

Resolved by the General Assembly of Maryland, That the Legisla-
tive Council be and it is hereby requested to (1) study thoroughly
the administration and in the various State agencies of Article 100,
Section 76, of the Annotated Code of Maryland, 1957 Edition and
1960 Supplement, and particularly Sub-section (b) thereof, which
empowers certain department heads and others to designate "those
bona fide supervisory employees who actually exercise supervisory
