CHAPTER 2
(House Bill 73)

AN ACT to repeal and re-enact, with amendments, Section 10 of
Article III of Section 261A of Article 66C of the Annotated Code
of Maryland (1964 Supplement), title "Natural Resources," sub-
title "Fish and Fisheries," subtitle "Part 1. General Provisions—
Compact of 1958," to add thereto certain descriptive verbiage and
to delete therefrom the provision prohibiting discrimination against
or distinction among residents of the State, as to the dredging of
soft shell clams, under the Potomac River Compact of 1958, so as
to conform same to the corresponding provision of said Compact
in the Code of Virginia.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 10 of Article III of Section 261A of Article 66C of the
Annotated Code of Maryland (1964 Supplement), title "Natural
Resources," subtitle "Fish and Fisheries," subtitle "Part 1. General
Provisions—Compact of 1958," be and it is hereby repealed and re-
enacted, with amendments, to read as follows:

10.

The Potomac River Fisheries Commission shall have the power
to make, adopt and publish such rules and regulations as may be
necessary or desirable for authorizing and regulating the dredging
of soft shell clams in areas within its geographical jurisdiction and
may levy license fees for such dredging in amounts to be set at IN its
discretion. [Any such rule or regulation shall not provide for or
permit any discrimination against or distinction among the residents
of any part of this State, as to the dredging of soft shell clams.]

Sec. 2. And be it enacted, That it is hereby requested that the
Governor issue a proclamation declaring the Act valid and effective,
as a similar Act has been passed by the Commonwealth of Virginia—
Code 1950, Section 28.1-227; 1964, C.24.

Sec. 3. And be it further enacted, That this Act is hereby declared
to be an emergency measure and necessary for the immediate preser-
vation of the public health and safety and having been passed by a
yea and nay vote supported by three-fifths of all the members elected
to each of the two houses of the General Assembly, the same shall
take effect from the date of its passage.
