1808                                      LAWS OF MARYLAND                                Ch. 894

(3)   EVERY STATEMENT SHALL BE UNDER OATH, BASED UPON
PERSONAL KNOWLEDGE AND SUBJECT TO PENALTIES OF
PERJURY.

(4)  STATEMENTS SHALL BE MAINTAINED BY THE SECRETARY OF
STATE FOR PUBLIC INSPECTION. [[AND COPYING THE SECRETARY
SHALL MAIL COPIES, AT REASONABLE COST, TO ANY PERSON
REQUESTING THEM.]]

28-3.

(A)    PERSONS HOLDING THE FOLLOWING ENUMERATED AND
DESCRIBED OFFICES AND POSITIONS SHALL FILE THE
STATEMENTS REQUIRED BY THIS SUBTITLE IN THE PRESCRIBED
MANNER:

[[(1) ANY PERSON ELECTED TO PUBLIC OFFICE OF THE STATE OF
MARYLAND BY STATEWIDE ELECTION;]] ANY PERSON ELECTED
TO A FEDERAL OR STATE PUBLIC OFFICE OF THE STATE OF
MARYLAND;

(2)  ANY PERSON ELECTED TO THE GENERAL ASSEMBLY;

(3)    THE TREASURER AND SECRETARY OF THE STATE OF
MARYLAND;

(4)     ANY PERSON ELECTED TO THE OFFICE OF COUNTY
EXECUTIVE, COUNTY COMMISSIONER OR COUNTY COUNCILMAN,
PRESIDENT OF THE COUNTY COUNCIL;

(5)     ANY PERSON ELECTED TO THE OFFICE OF MAYOR,
PRESIDENT OF THE CITY COUNCIL, OR CITY COUNCILMAN OR
ALDERMAN;

(6)   ANY SECRETARY OR DEPUTY SECRETARY OF A PRINCIPAL
EXECUTIVE DEPARTMENT OF THE STATE OF MARYLAND:

(7)      ANY PERSON APPOINTED TO A VACANCY IN AN
AFOREMENTIONED OFFICE OR POSITION.

(8)   ANY PERSON ELECTED OR APPOINTED TO THE JUDICIARY.

(B)   THE GOVERNOR, OR THE COUNTY OR CITY AUTHORITY
HOLDING THE EXECUTIVE POWER WITHIN ITS JURISDICTION, MAY
EXTEND BY EXECUTIVE ORDER THE REPORTING REQUIREMENTS
OF THIS SUBTITLE TO ANY OTHER POSITION COMPENSATED IN
WHOLE OR IN PART BY PUBLIC FUNDS, OR TO ANY
NON-COMPENSATED APPOINTIVE POSITION, IF:

(1)   THE GOVERNOR OR THE APPLICABLE AUTHORITY, AS THE
CASE MAY BE, DETERMINES THAT THE DUTIES OR
RESPONSIBILITIES OF THE POSITION ARE COMPARABLE TO THOSE
OF THE POSITIONS ENUMERATED IN SUBSECTION (A) OF THIS
SECTIONS; OR

(2)  THE CLOSENESS TO REAL ESTATE MATTERS, SENSITIVITY OF
FUNCTION, OR OTHER ATTRIBUTES OF THE POSITION INDICATE
THAT IT WOULD SERVE THE PUBLIC INTEREST TO REQUIRE THE
DISCLOSURE PRESCRIBED BY THIS SUBTITLED.
