staff provided in the State budget. To the extent
practicable, the State prosecutor shall utilize the
services and personnel of the OFFICE OF THE ATTORNEY
GENERAL, THE Maryland State Police, and other established
State and law-enforcement agencies. These agencies
shall, to the extent feasible, cooperate with the State
[[prosecutor]] Prosecutor and his staff.

SECTION 2. AND BE IT FURTHER ENACTED, That Sections
33D through 33F, inclusive, to be under the new subtitle
"State Prosecutor Selection and Disabilities Commission"
of Article 10 - Attorneys at Law and Attorneys in Fact,
of the Annotated Code of Maryland (1968 Replacement
Volume and 1975 Supplement) be and they are hereby
repealed and reenacted, with amendments, to read as
follows:

Article 10 — Attorneys at Law and Attorneys
in Fact

STATE PROSECUTOR SELECTION AND DISABILITIES
COMMISSION

33D.

(a) The State Prosecutor Selection and
Disabilities Commission is created. It consists of [the
Chief Judge of the Court of Appeals, the Chief Judge of
the Court of Special Appeals, the Chief Judge of the
District Court,] the Attorney General, [all] ex officio,
but with power to vote, and [five] SIX persons appointed
by the Governor, as follows:

(1)    [Three] TWO persons [[ONE OF WHOM SHALL
BE A LAWYER]] , ONLY ONE OF WHOM SHALL BE A LAWYER, shall
be SELECTED FROM AMONG TWO OR MORE [the] nominees
submitted [jointly] by the President of the Senate and
TWO PERSONS ONLY, ONE OF WHOM SHALL BE A LAWYER, [[ONE OF
WHOM SHALL BE A LAWYER]] SHALL BE SELECTED FROM AMONG TWO
OR MORE NOMINEES SUBMITTED by the Speaker of the House of
Delegates. These persons shall not be members of the

General Assembly[, lawyers] [[,___lawyers]] or full—time

State employees.

(2)    One person shall be [the nominee]
SELECTED FROM AMONG ONE OR MORE NOMINEES submitted by the
Board of Governors of the Maryland State Bar Association,
Incorporated. This person shall be a lawyer admitted to
practice law in Maryland.

(3)    One person shall be [the nominee]
SELECTED FROM AMONG ONE OR MORE NOMINEES submitted by the
governing board of the Maryland State's Attorneys
Association, Incorporated, or its successor. This person
shall be an incumbent State's [[attorney]] Attorney AT
THE TIME OF HIS APPOINTMENT AND THROUGHOUT HIS TERM AS A
MEMBER OF THE COMMISSION.
