LAWS OF MARYLAND
word doctor or the abbreviation Dr., or any word or
abbreviation that will or can convey the impression that
he is engaged in the treatment of diseases or injuries of
the human eye, or make use of drugs, medicine or surgery,
in the practice of optometry[, shall be guilty of a
misdemeanor, and upon conviction thereof shall be fined
not more than five hundred dollars, or imprisoned not
more than six months, or both fined and imprisoned, in
the discretion of the court; provided, however, that],
HOWEVER, any person who holds a standard examination
certificate issued by the Maryland State Board of
Examiners in Optometry to practice optometry in the State
of Maryland and who has received a degree from a legally
chartered college having the authority to give the degree
of "doctor of optics" or "doctor of optometry" may use
the title doctor of optics or doctor of optometry in
connection with his name. (B) AN OPTOMETRIST WHO DETECTS AN ACTIVE EYE
PATHOLOGY SHALL REFER THE PATIENT TO A PHYSICIAN. [384.] 380. [The provisions of this] THIS subtitle [shall] DOES
not apply [nor be construed to apply to persons who sell
spectacles, eyeglasses or lenses as merchandise, or] to;
(1) PHYSICIANS LICENSED TO PRACTICE MEDICINE IN MARYLAND; (1) (2) opticians who furnish glasses on [an order from an oculist, or to physicians and surgeons who are authorized to practice in this State,]THE PRESCRIPTION OF AN OPTOMETRIST OR A LICENSED PHYSICIAN;
or [to] (2) (3) dealers in spectacles, eyeglasses or lenses who neither practice nor profess to practice optometry as defined in this subtitle. [385.] 381. [Any] AN optometrist practicing [optometry] in the
[State of Maryland must] State of Maryland MAY use ONLY
the [word] TITLE optometrist, [and the word optometrist
only,] DOCTOR OF OPTOMETRY, OR DOCTOR OF OPTICS in
connection with his name [wherever said name appears
except as provided for in § 384]. SECTION 4. AND BE IT FURTHER ENACTED, That new
Sections 376 and 383 be and they are hereby added to
Article 43 - Health, of the Annotated Code of Maryland
(1971 Replacement Volume and 1976 Supplement) to read as
follows: Article 43 - Health 376. (A) THE BOARD SHALL KEEP A CURRENT LIST OF ALL
