EXECUTIVE ORDERS

2-309(a), in this instance, will not be detrimental to
the State or its citizens;

NOW, THEREFORE, I, BLAIR LEE III, ACTING GOVERNOR OF

MARYLAND, BY THE AUTHORITY VESTED IN ME BY ARTICLE II,

SECTION 6 OF THE MARYLAND CONSTITUTION, AND BY THE

TRANSPORTATION ARTICLE, SECTION 2-309(B) OF THE
ANNOTATED CODE OF MARYLAND, DO HEREBY:

1.  Declare that an emergency exists, within the
meaning of Section 2-309(b) of the Transportation Article of
the Code, with respect to the selection of an engineering
consultant for the Hawkins Point Marine Terminal Project.

2.  Direct, in light of the emergency, that the
Maryland Port Administration, as the requesting
transportation agency and the Secretary of Transportation,
request that the Transportation Professional Services
Selection Board waive the provisions of Section 2-309(a) of
the Transportation Article with respect to the selection of
an engineering consultant for that project; and

3.  Request that the Transportation Professional
Services Selection Board honor the requests of the Maryland
Port Administration and the Secretary of Transportation, and
waive the provisions of Section 2-309(a) with respect to the
selection of an engineering consultant for that project.

PROCLAMATION OF FEBRUARY 20, 1979

WHEREAS, I, Harry R. Hughes, Governor of the State of
Maryland, have been advised and informed that a State
of public crisis, emergency and civil disturbance
exists within the City of Baltimore;

WHEREAS, Injuries to persons and destruction of property
have occurred, or are imminent; and there is a
probability that the same will occur or continue to
occur; and that public safety is thereby imperiled;

NOW, THEREFORE, I do hereby proclaim, pursuant to the
authority vested in me by the Constitution and laws of
the State of Maryland, that a state of public emergency
and crisis exists in the City of Baltimore,

and I do further proclaim and announce that I shall
promulgate such reasonable orders and regulations as I
deem necessary to protect life and property and bring
the public disorder under control.
