(h) Nothing in this section shall be deemed to impair
or limit the powers of the State Department of Human
Resources, the State Department of Education, or the State
Department of Health granted under any of the other
provisions of this Code unless the same are necessarily
inconsistent herewith.]

FAMILY DAY CARE HOMES

32D.

IT IS THE POLICY OF THIS STATE TO ENCOURAGE THE
DEVELOPMENT OF DAY CARE SERVICES FOR CHILDREN IN A SAFE,
HEALTHY, AND HOMELIKE ENVIRONMENT. TO ACHIEVE THIS END,
THERE IS ESTABLISHED A SYSTEM OF REGISTRATION FOR FAMILY DAY
CARE HOMES. THE SYSTEM OF REGISTRATION IS INTENDED TO
PROMOTE A HIGH DEGREE OF FLEXIBILITY IN THE REGULATION OF
FAMILY DAY CARE HOMES WHILE ASSURING THE SAFETY AND HEALTH
OF CHILDREN WHO ARE CARED FOR IN THE HOMES.

32E.

(A)  (1) IN THIS SUBTITLE, THE FOLLOWING TERMS HAVE THE
MEANINGS INDICATED.

(2)  "DEPARTMENT" MEANS THE STATE DEPARTMENT OF
HUMAN RESOURCES.

(3)  "FAMILY DAY CARE" MEANS CARE GIVEN TO A
CHILD:

(I)  IN LIEU OF PARENTAL CARE;

(II)  IN A RESIDENCE OTHER THAN THE
CHILD'S;

(III)  FOR LESS THAN 24 HOURS PER DAY; AND

(IV)  FOR WHICH COMPENSATION IS PAID.

(4)  "FAMILY DAY CARE HOME" MEANS THE RESIDENCE
IN WHICH FAMILY DAY CARE IS PROVIDED.

(5)  "PROVIDER" MEANS THE ADULT WHO HAS PRIMARY
RESPONSIBILITY FOR THE OPERATION OF A FAMILY DAY CARE HOME.

(6) "PROVIDER'S ASSISTANT" MEANS AN ADULT WHO

HAS SECONDARY RESPONSIBILITY FOR THE OPERATION OF A

PROVIDER'S FAMILY DAY CARE HOME AND WHO MEETS ANY

REQUIREMENT OR STANDARD APPLICABLE TO THE PROVIDER.

(B)  (1) A PROVIDER MAY NOT CARE FOR MORE THAN 2
CHILDREN UNDER 2 YEARS OF AGE NOR MORE THAN A TOTAL OF 6
CHILDREN OF ANY AGE AT ANY GIVEN TIME.
