(Senate Bill 300)

AN ACT concerning

Energy Conservation Building Standards

FOR the purpose of continuing the authority of the Department of
Economic and Community Development to enforce the Energy
Conservation Building Standards Act; repealing the scheduled
termination of certain provisions of that Act; and generally
relating to the Energy Conservation Building Standards Act.

BY repealing and reenacting, with amendments,

Article 78 - Public Service Commission Law
Section 54-I(b)(l), (c)(1), and (h)(3)(i)
Annotated Code of Maryland
(1980 Replacement Volume and 1985 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 78 - Public Service Commission Law

54-I.

(b)  (1) Except as provided in subsection (d) of this
section, a builder of any new building that is completed after
July 1, 1982 [and prior to July 1, 1987,] shall certify under
oath or affirmation to the electric company designated to provide
electric service to the building that the building meets the
latest edition of the BOCA Energy Code. However, if the building
was designed while the immediately preceding edition of the BOCA
Energy Code was in effect and the building was constructed in
accordance with the then preceding edition of the BOCA Code, the
builder may so certify in order to satisfy the requirements of
this subsection.

(c)  (1) Except as otherwise provided in this section, an
electric company may not provide electric service to any building
on which construction is completed after July 1, 1982 [and prior
to July 1, 1987,] unless the builder has filed with the company
the certificate or waiver that is required under this section.

(h) (3) (i) In any political subdivision which has adopted
the BOCA Energy Code, if a builder of a building which is
completed after July 1, 1982 [and prior to July 1, 1987]
willfully deviates from the approved plans for the building, the
builder is liable to the first purchaser who either occupies or
rents the building for an amount not to exceed $2,000 and for the
cost of bringing the building into compliance with the BOCA
Energy Code. The builder is also liable for the reasonable
