WILLIAM DONALD SCHAEFER, Governor                   Ch. 306

The provisions of this subtitle do not add to the
jurisdiction of the Department of [Health and Mental Hygiene]
NATURAL RESOURCES.

[8-11A-08] 4-208.

(a)  Any person who violates any provision of this subtitle
is guilty of a misdemeanor and upon conviction in a court of
competent jurisdiction is subject to a fine not exceeding $5,000
or imprisonment not exceeding 1 year or both for each violation
with costs imposed in the discretion of the court. Each day upon
which the violation occurs constitutes a separate offense.

(b)  Any agency whose approval is required under this
subtitle or any interested person may seek an injunction against
any person who violates or threatens to violate any provision of
this subtitle.

(c)  As an alternative to a criminal action as provided for
under this section, the Department or the Department of [Health
and Mental Hygiene] NATURAL RESOURCES, as appropriate, or a
political subdivision may bring a civil action against any person
for any violation of this subtitle. The action may seek the
imposition of a civil penalty of not more than $5,000 against the
person, an injunction to prohibit the person from continuing the
violation or both.

(d)  For purposes of a civil action brought under subsection
(c), each day during which a violation continues constitutes a
separate offense.

Subtitle [12] 3. Watershed Sediment and Waste Control

[8-1201] 4-301.

(a)  In this subtitle, the following words have the meanings
indicated.

(b)  In this subtitle the word "Watershed" means the
Patuxent River Watershed and the Severn River Watershed.

(c)  The "Patuxent River Watershed" is the land and water
area from which all water drains either directly or indirectly to
the Patuxent River.

(d)  The "Severn River Watershed" is the land and water area
from which all water drains either directly or indirectly to the
Severn River.

The General Assembly declares that the Patuxent River and
the Severn River are a great natural asset and resource to the
