Preamble

WHEREAS, The General Assembly finds and declares that the
practice of respiratory care affects the public health, safety,
and welfare of the citizens of this State; and

WHEREAS, It is the purpose of this Act to make provision for
minimum standards for the training and certification of medical
personnel to protect the public from the unauthorized and
unqualified practice of respiratory care and from unprofessional
conduct by persons certified to practice respiratory care; now,
therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Health Occupations

14-605.1.

(A)  THE BOARD SHALL:

(1)  DEFINE, FOR THE PURPOSE OF THIS SECTION, THE
TERMS "RESPIRATORY CARE PRACTITIONER" AND "PRACTICE RESPIRATORY
CARE";

(2)  ADOPT REGULATIONS IN CONSULTATION WITH AFFECTED
HEALTH PROVIDERS CONCERNING QUALIFICATIONS, TRAINING,
CERTIFICATION, MONITORING OF, AND ENFORCEMENT REQUIREMENTS FOR A
RESPIRATORY CARE PRACTITIONER;

(3)  PROVIDE FOR A REQUIREMENT TO ENSURE CONTINUED
COMPETENCY IN THE PRACTICE OF RESPIRATORY CARE; AND

(4)  PROVIDE DISCIPLINARY PROCEDURES FOR RESPIRATORY
CARE PRACTITIONERS.

(B)  THE QUALIFICATIONS REQUIRED OF AN APPLICANT FOR
CERTIFICATION BY THE BOARD AS A RESPIRATORY CARE PRACTITIONER
SHALL INCLUDE REQUIREMENTS ESTABLISHED AND APPROVED BY:
