EXECUTIVE ORDER OF SEPTEMBER 23, 1988

MARYLAND JUVENILE JUSTICE ADVISORY COUNCIL
(Amends Executive Order 01.01.1988.01)

WHEREAS, The Federal Juvenile Justice and Delinquency Prevention
Act of 1974 (P.L. 93-415), as amended by the Juvenile
Justice Amendments of 1980 (P.L. 96-509), requires that each
state designate a single state agency to receive formula
grants for the creation of a juvenile justice advisory
group;

WHEREAS, The Maryland Juvenile Justice Advisory Council was
created as a unit within the Governor's Office for Children
and Youth by Executive Order 01.01.1987.21 on October 5,
1987 for the purpose of serving as the State recipient of
formula grants;

WHEREAS, The Maryland Juvenile Justice Advisory Council was
restructured as an independent unit within the Governor's
Office by Executive Order 01.01.1988 on January 27, 1988;
and

WHEREAS, It is necessary for the Governor to confirm that the

State is committed to the removal of juveniles from adult

jails and lockups in order for the State to be eligible to

receive a supplementary grant award of $163,000;

NOW, THEREFORE, I, WILLIAM DONALD SCHAEFER, GOVERNOR OF THE STATE
OF MARYLAND, BY VIRTUE OF THE AUTHORITY VESTED IN ME BY THE
CONSTITUTION AND LAWS OF MARYLAND, HEREBY PROMULGATE THE
FOLLOWING ORDER AMENDING EXECUTIVE ORDER 01.01.1988.01, AS
FOLLOWS, EFFECTIVE IMMEDIATELY:

A.  The Maryland Juvenile Justice Advisory Council (The
Council) is established as a unit within the Governor's
Office [for Children and Youth].

B.  The membership of the Council shall be appointed by the
Governor in accordance with the requirements of Section 223
of the Juvenile Justice and Delinquency Prevention Act of
1974, as amended (hereafter called the Act). The Council
shall consist of not fewer than 15 members nor more than 33
members:

(1)  The Governor shall designate the Chairman of the
Council from among the members appointed;

(2)  The term of a member is three years. In case of
a vacancy, the Governor shall appoint a successor for the
remainder of the unexpired term. The member's term shall be
staggered as established during the initial appointments;
