said John Fleming for and in consideration of the premises and in
order to secure to the said William Otis the repayment of the sums of
money already advanced and those which may hereafter be advanced
by him to or on my account and of the sum of Five dollars Current
money to me in hand paid by the said William Otis at or before the
sealing and delivery of these presents and the receipt whereof is hereby
acknowledged have granted bargained and sold and by these presents
do grant bargain and sell unto the said William Otis his Executors
administrators and assigns the following personal property now in my
possession to wit  Eight Horses as follows Two mares One Bay and one Gray
One Sorrel Horse (Charlie) one sorrel horse John one Bay horse Charlie
One Bay horse Billy one Grey horse Tom one horse Old Billy and Fore
Rail Road Carts & harnesses & Shanty and Stable  To have and To hold
the aforesaid described property and every part and parcel thereof unto
and to the use of the said William Otis his Executors administrators and
assigns for ever provided nevertheless and these presents are upon this
Condition that if I the said John Fleming my Executors or administrators
shall on or before the first day of April Next well and truly pay unto
the said William Otis his Executors administrators and assigns the aforesaid
Sum of money now due and owing from me to him with interest thereon
from this date and such further sum or sums of money as may hereafter
become due and owing from me to him for monies advanced by him to or on
my account or otherwise with property Interest thereon then and in
Such Case these presents shall be utterly null and void  And it is
further to be understood that until default shall be made in payment
of the aforesaid sum or sums of money or some part thereof it shall and
may be lawful for me to retain possession of the aforesaid property and the
same to use and employ in my proper business and for my proper profit
In Witness whereof I have hereunto set my hand and seal this fifteenth
day of November in the year Eighteen hundred and thirty Eight

          On the back of the aforegoing was thus written to wit

Anne Arundel County to wit  On this fifteenth day of November in the year
1838 before the subscriber a Justice of the peace in and for said County personally
appeared the within named John Flemming and acknowledged the
foregoing Instrument of writing to be his act and deed
