Upon his Excellency's laying before the Board the Rt
Honrble the Lords Comrs of Trade and Plantations Lres of the
3d December 1700 as to the first Paragraph relating to the
number of the Inhabitants and Planters his Excy saith that he
hath with great Difficulty att last sent them to their Lordships,
also their Ldps Lre of the 4th January 1700 Signifying that our
Laws sent for England were Still lying before his Matys
Attorney & Sollicitor Genll his Matys Pleasure att present
unknown thereupon.
Therefore it was proposed that a Conference should be
had with the house as in the following Message sent by the
honble Thomas Tench Thomas Brook, Jas Frisby Esqr and Col
John Hammond vizt

By his Excy the Governor and Councill in Assembly
May the 9th 1701.
Gentn
It seems to us that the most Important Service will be
Capable of it the due Consideration and reflection we ought
to make upon the present state & Condition of our Laws
sent home for England the last Assembly and now as we are
Informed by the Lds Comissrs of Trade and Plantations lying
before his Matys Attorney and Sollicitor Generall not as yet
Certain what determination they may fall under from his

most Sacred Majesty in reguard of some Apparent Incon-
veniencyes Especially in the Law entituled an Act repealing
Certain Laws of this Province and Confirming others wherein
we are doubtfull to make the same unhapy Mistake as in the
Year 1699 by Joining them altogether so that it has been
Offered That his Maty Cannot give his Consent to any Laws
unless all, and in the like maner disallow any Single Act the
whole Involved in the same Determination upon this Impor-
tant Occasion.
We are very desirous to have a Conference with Mr
Speaker and Some Competent Number of Your house, that
if possible we may timely obviate any Prejudice or detriment
arising therefrom in which we shall heartily Join with you.
