Then he was ordered to withdraw, And the board Resolved Lib. C. B. he be Comitted for high Treason. John Welch brought before his Excy & the board and Charged with Associateing with Richard Clarke last winter in Christmas last at his Brother Silvester Weiches house together with Wintersell and Harrison and also for receiving him in his owne house in the night when said Clarke Came with Harrison the Last Winter Silvester Welch being again Sent for denyed that ever Clarke or Harrison were at his house in Christmas Last. Advised that Clarke Wife and his son Neale Clarke be released upon giving moderate bayle and assureance not to come near her husband or Converse with him but keep her self at her Brother Daniells, And that Assureance be given the boy shall not goe to him. And Daniell Wells be Admitted to bayle giveing good p. 85 Security. Ordered that Notice be sent to the Justices of the Provin ciall Court of that Comission being altered so that their attendance will not be necessary at the next Court Mr Amos Garrett Called before the board is told he shall have his Servant William Stimpson delivered him out of prison if he will oblige himself The said Stimpson shall not disturbe the peace of the Country. Mr Garrett says he will not be obliged for his behaviour.

His Excellency acquaints the board how much he resents the Neglect of the Sherriff of Ann Arundell County in Suf fering the three Malletts who had robbed the Indian Tombes to Escape, and that he was resolved he should be prosecuted for his Carelessness, and desired their opinion whether upon Representing the Matter to the Judges of the Provinciall Court it would not be Sufficient Ground for them to fine him therefore To which the board are of opinion that it will. The ill behaviour of Severall Attorneys practiceing in the provinciall & County Courts of this province who often En deavour to be very popular and independent of the Govern ment falling under the Consideration of his Excy and this
