Lib. C. B. Nicholas Gassaway Deceased Her Majesty taking, the same into her Consideration is pleased with the Advice of her privy Councill to Order, That the petitioner be Admitted to appeal from the said Judgment to the Governour and Coun cill of the aforesaid Province Notwithstanding any Lapse of time in making his said Appeale provided the Governour and Councill there have no other Legall Objection thereunto, and in Case they have that then they Returne an Acct thereof to her Majesty at this Board. And the Governour or Coman- p. 111 der in Cheif and Councill of Maryland for the time being, and all others whom it may concerne are to take Notice of this her Majestys Pleasure, and pay all due Obedience there- unto Accordingly. Mr Saml Chew Called in and Ordered to get the Case Stated that his Excy and this Board may proceed in Comply ance thereto. Then was Read a Letter from Richard Clark to his Excy dated the 30th of Ianry last and dropt at David Bells Mill, Wherein the said Clarke Expresses a deep sence of the Hor rour and detestation of his Crimes and that he lyes under the Denomination of a Traytor to her Majesty and Offers to come in and Submitt himself to his Excys Mercy, Where upon the Board advise his Excy that the said Clarke Surren der to Mercy and be received but without making any Termes with him, And that his Excy be pleased to appoint a proper person to receive and protect him from any Violence in Comeing in. Ordered that proclamation relating to proceedings at Law how regulated in relation to the assizes be Jssued to the Sev erall Countys that the Sevll Suiters may know how to Con- forme themselves thereto. Mr John Coode Mr Wm Stone Mr John Kirk Mr John Willinger and Mr Thomas Boon practitioners of the Law in Severall County Courts of this province were approved and Lycenced by his Excy and the Councill. The honble Thomas Tench Esq Recomended to be Judges of the Court of Vice Admiralty in this Province. p. 112 Then his Excy and the Councill proceeded to Consider of the Affaire concerning Thomas Macnemara and his Wife & Col: Thomas Smithsons bayling him on the Attachmt of Contempt. And first on the Question Whether his Excy has done any thing in the Case illegally or that can Look like preju- dice They say they cannot thinke so in the least.
