Thousand Pounds of tobacco the Collectors and receivers of
the Lord Baltemores Revenues or their Deputies Tenne
Thousand pounds of tobacco to be recovered as aforesaid
wherein No Essoyne Protection or Wager of Law to be Allowed.
And be it further Enacted and Declared by the Authority
advice and Consent aforesaid That if any of the places by this
Act Appointed for Ports or Towns shall happen to be upon
the dwelling plantation or plantations of any pson or psons
Whatsoever whereon there is Erected any Dwelling house or
other Houses or whereon there is Planted any Orchard or
garden and the Lott or quantity of Land by this Act allowed
to the Owner thereof for his Choice will not include such
houses orchards or gardens that then it shall be in the Power
of the said Comrs in Each respective County or the Majr part
of them either to Allow to such Owner or Owners of such
houses Orchards or Gardens what Other or more recompence

or lotts such Commissioners or the Majr part of them or the
Jury afd shall Conceive such houses Orchards or Gardens may
be worth over and above the Value of the Land so as afd to
be Assessed by the said Commissioners or Jury Any thing in
this Act to the Contrary notwithstanding.
