PUBLIC LEDGER, 1763

[THIS OLD MANUSCRIPT IN THE STATE ARCHIVES, EN-
TITLED "BRIEF ANSWERS TO QUERIES RELATIVE TO THE
GOVERNMENT OF MARYLAND THAT WERE INSERTED IN
THE PUBLIC LEDGER OF THURSDAY NOVEMBER I7TH

1763", WAS OBVIOUSLY WRITTEN BY SOME REPRESENTA-
TIVE OF THE PROPRIETARY GOVERNMENT, PROBABLY FOR,

AND POSSIBLY BY, CECILIUS CALVERT, PROVINCIAL SEC-
RETARY OF MARYLAND IN ENGLAND. THESE "BRIEF
ANSWERS", WHICH OMIT THE QUESTIONS TO WHICH THEY
ARE REPLIES, MAY HAVE BEEN A PRELIMINARY DRAFT OF
THE ANSWERS AS THEY ARE TO BE FOUND IN THE ANONY-
MOUS PAMPHLET PRINTED IN 1764: An Answer to the
Queries on the Proprietary Government of Maryland etc,
REPRODUCED IN THE APPENDIX OF THIS VOLUME (PP.
409-457). THESE "BRIEF ANSWERS" AND THE PAM-
PHLET "AN ANSWER" ARE MORE FULLY DISCUSSED IN
THE INTRODUCTION (PP. Ixx-lxxii).]


BRIEF ANSWERS TO THE QUERIES RELATIVE TO THE
GOVERNMENT OF MARYLAND THAT WERE INSERTED
IN THE PUBLIC LEDGER OF THURSDAY NOVEMBER
17.TH 1763

To the 1.st The Legislature of Maryland does consist of three
Branches viz.t The Lord Proprietary (who is heriditary Governor)
or his Lieutenant Governor appointed with the King's Approbation),
the Upper House of Assembly, & the Lower House elected by the
People.
2.d As the Council or second Branch of the Legislature in the
Provinces of New Hampshire New York, the Jersies Virginia the
Carolinaes & others of His Majesty's American Governments con-
sists of Gentlemen nominated by the King, so in Maryland (the
Jurisdiction as well as Property being by his Charter vested in the
Lord Proprietary) the Members of the second Branch of the
Legislature are nominated by the Lord Proprietary agreeable to his
Charter & to an express Act of Assembly, As in the Governments

which are immediately in the Crown the Council or Members that
comprise the second Branch in the Legislature are liable in case of
seditious Practices or other Misbehaviour to be suspended or dis-
placed by His Majesty which had been often done, it is presumed
that they may in like manner be suspended or removed in Maryland
by the Lord Proprietary & indeed there have since the first Settle-
