At a GENERAL ASSEMBLY, begun and held at
    St. Leonard's, on the 27th April 1658.

CHAP. I.
Acts made and enacted by JOSIAS FENDALL, Esq; Governor, with the Advice 
    and Consent of the Upper and Lower Houses, at a General Session of Assembly,
    held at St. Leonard's, beginning the 27th April, Anno Domini 1658.  Lib.
    C and WH. fol. 134.  Lib. WH. fol. 154. and Lib. WH and L. fol. 17
    Confirmed among the perpetual Laws, by 1676, ch. 2.
    N.B.  This Act recites in the Preamble, his Lordship's Commission, and Instructions to his 
Lieutenant and Secretary, dated 18th November 1657, impowering them to treat with the Commissioners,
in whose Hands the Government then was; who, upon Articles agreed on, dated
24th March 1657, delivered up the Government into the Hands of the said Lieutenant and Secretary.
The above mentioned Articles are inserted at large, in the Body of the Act, and confirmed
thereby.
    By the Oath of these Articles, the Oath of Fidelity prescribed in the Act of 1650, ch. 29, was
not to be pressed upon the Residents within the Province; but instead thereof an Engagement to
be taken and subscribed, in the Manner and Form directed in this Article.

An Act for the Burgessess Charges.  OBS.
    N.B.  An Assembly met on the 28th February 1659, at the House of Mr. Thomas Gerrard,
pursuant to Writs issued for that Purpose, bearing Date the 12th January preceding; and adjourned
on the 1st of March, to the House of Mr. Robert Slye, where they continued to sit till the
12th Instant, when the Burgesses sent up the following Paper:
                                " TO THE HONOURABLE THE GOVERNOR AND COUNCIL..
    " That this Assembly of Burgesses, judging themselves to be a lawful Assembly, without Dependence on
" any other Power in the Province, now in Being, is the Highest Court of Judicature.  And if any Objection
" can be made to the contrary, we desire to hear it.                       ROGER ISHAM, Clerk of the Assembly."
    This Paper was answered by certain Queries sent down to the Lower House, who thereupon
demanded a Conference, which was granted, and held that Day.  On the 13th, Governor Fendall
(in pursuance of his before projected Scheme) declared his Judgment to be, that "the
