David Browne Capta: John Winder: mr: William Brereton and mr: Robert King alwaies to be
one Justices within y Said County of Sommersett to hear & determine all Causes or actions of debt
howsoever and in what manner Soever ariseing all actions of Trespas upon the Case arising for
goods wares & other things Delivered money or goods lent or upon note booke or account wth:out
restraint to any summe or quantity whatsoever alsoe all accons: of Trespasse quare Clausum fregitt
provided noe Titles of Land depends upon the Tryall of Such actions: Detinure Surtrover Replivin
accons of Accompt Covenant waste assault menace Battery and Imprisonment actions of slandr:
for words Spoken provided in the delaracon drawne & filed in and upon any the Said accons of

at the Certaine dayes Setled by the Law of this our province for holding Courts in or: sd: County
the Said actions you inquire into hear & determine and after Judgement execucon to award
Doeing therein What to Justice appertaineth according to the Lawes & reasonable Customes of this
our Province Saving to us the amercemts: & other things to us appertaining To all his Majesties
Subjects resideing here under our Imediate protection or tradeing within this our Province theire
right of appeale and bringing writts of Error in our Provincial Court as now by Laws Settled
And wee Comand our Sheriffe of or: Said County That at all the dayes and places by you or any five
or more of you to be appointed as aforesaid he Cause to Come before you Such and Soe many honest
and Lawfull men of his baliwick by whome the truth of the premisses may the better be knowne -
& enquired into And wee doe hereby declare that it Shall & may be Lawfull And wee doe hereby-
Autherize and Impower any one and no more att any one time of or: Justices of or: Provinciall Cort:
resideing and inhabiting in or:Said County of Somersett to Sitt with the aforesaid Justices as president
in the hearing and determining all or any of the aforesaid actions and that Such one of the said
Justices of or: Provinciall Court resideing as aforesaid and Three of the Said Justices to be Sufficient
for the holding Courts for the determining the Causes and actions aforesaid any thing to the
Contrary notwithstanding in testimony whereof wee Caused the great Seale of our sd: Province
of Maryland to these presents to be affixed the 30th: day of September in the Twelfth year of our dominion
&c Annoq Dom: 1687 ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~ ~
The Tenor of the Commissioners Oath
You Shall Swear that as Commissioner in the County of Somr:sett in all Articles in his Lordsps:
Commissions directs To the Commissionrs: & Justices of Somersett County you Shall doe equall right
to the poore as to the ritch to the best of you: Cunning witt & power and after the presidents and
Customes of this Province And Acts ofAssembly thereof made And that you hold Sessions &
Courts as you are directed in yor: Commissions or according to Acts of assembly Provided in that
behalfe: And all fines and Amercements that Shall happen to be made and all forfeitures
that Shall happen to fall before you you Shall Cause to be entered without any Concealement
and Certifye the Same to his Lordsps: receiver generall of this Province you Shall not debarr or hinder
the prosecution of Justice to take any guift bribe or fee to the intent or delaying of Judgement
but Shall behave yor: Selfe Justly & truly to the best of yor: understanding & power soe long as you
Shall persist in this office and untill you Shall be by Lawfull Authority discharged therefrom
