CHAPTER 160.
AN ACT to amend the Lottery System.
Other laws are, 1828, ch. 129; 1831, ch. 79, 284; 1835, eh. 205. See
notes to 1821, ch. 232, ante page 777.
To prevent and punish the violations of the various provisions of this
law, various amendments thereto have been incorporated with the laws of
this state, yet, as none of them repeal directly any of the enactments of this
law, it is deemed proper that the responsibility of giving a construction to
these laws, should be left to the judicial tribunals of this state. They will
therefore be reprinted, except where there shall be an obvious conflict.

SEC. 1. Be it enacted, by the General Assembly of Maryland
That before any commissioner of lotteries shall proceed to act
as such, or shall be entitled to receive any salary, or other com-
pensation whatsoever, he shall give bond to the state of Mary-
land, with two securities to be approved by the governor and
council, each bond to be in the penal sum of twenty thousand
dollars, conditioned, that the said commissioner shall well and
truly perform and discharge the several duties required of him
as a commissioner of lotteries, and that he will abstain from
and avoid all manner of concern or interest in the gain or loss
of any lottery scheme, and that he will not be concerned in the
purchase of any lottery ticket or tickets, part or parts thereof,
and that he will faithfully pay over all moneys which shall
come into his hands, as a commissioner of lotteries, to the per-
son or persons, body or bodies corporate or politic, who shall be
entitled to receive the same, and that he will in all respects
comply with the requisitions of the existing laws of this state,
and of such as may hereafter be enacted in relation to his
duties as a commissioner of lotteries ; and the said bond shall
be recorded among the records of the executive department, by
the clerk of the council, and a copy thereof under the seal of
the department, shall be to all intents and purposes as available
evidence in any court of justice in this state, as the original
would be if produced and legally proved ; and the state of
Maryland, and all bodies corporate or politic, or individuals,
who may be interested in the performance of the duties intended
to be secured by the said bond, shall be at liberty to demand a
copy thereof, and to institute a suit or suits thereon, in the
name of the state, for his, her or their use, and may recover
thereon the full amount of debt or damages, which he, she, or
they may shew him, her or themselves to be entitled to, or may

have sustained: Provided however, that the present commis-
sioners may be allowed until the first Monday of May next, to
give the bond required by this act, and in the mean time may
proceed to act, under the bonds which may have been given
according to the provisions of the act of December session,
eighteen hundred and twenty six, chapter two hundred and
