due, if any day appointed for payment, according to the above rule laid
down,
by comparing the value of the paper money due, or paid by, the state, with
gold
or silver; and any claims so stated, liquidated and passed, by the auditor-general,
or his deputy, shall be laid before the governor and the council, who,
after examination
thereof, and correcting any error therein, may give their order on the
treasurer
of the western shore for the sum due, in specie, who shall give a certificate
for the sum expressed in the order, payable to the person, or bearer, in
specie, of
the value of seven shillings and six-pence for a Spanish milled dollar,
and bearing
an annual interest of six per cent. |

III. And be
it enacted, That interest shall be allowed on all debts due from
the state, from the day the same ought to have been paid, and included
in the
certificate to be given as aforesaid; and this state will, as soon as possible,
discharge
the principal, or such part thereof as may be in their power, and if the
public finances will not permit, then the general assembly will provide
funds for
the punctual payment of the interest. |

IV. And,
whereas for goods and articles of produce taken or furnished for the
use of the army on the credit of this state, such very different prices
or valuations
have been set and certified, that in many instances individuals will, if
the legislature
does not interfere, receive double the price of others for the like article;
Be
it enacted, That the auditor, with the approbation of the governor
and council,
may, and he is hereby directed, in liquidating and ascertaining in specie
any account
or certificate for goods or produce furnished, or taken or seized, settle
and
adjust the same, according to the true and real value of such articles
at the time
and place the same was furnished or seized, according to the common selling
price
of such articles at such time and place; but if the party shall think himself
aggrieved
by such settlement, the auditor is required to forbear certifying the said
settlement, and to lay the same before the general assembly at their next
session
thereafter. |

V. And,
whereas certificates under the act for the payment of the journal of
accounts, and for other purposes, passed in March session seventeen hundred
and
seventy-eight, issued on divers days, and bearing different dates, and
therefore the
settlement thereof by the general rule before laid down would not do equal
justice;
Be it enacted, That all certificates
and claims under the said act shall be settled
and adjusted, as if the same were granted, or due and payable, on the seventeenth
day of March, seventeen hundred and seventy-eight. |

CHAP. XX.
An ACT to explain and amend the act to settle and adjust the accounts
of the troops of this state in the service of the United
States, and for other purposes therein mentioned. |

WHEREAS, on the sale by the commissioners appointed
to preserve
confiscated British property, of some lots and parcels of land in or
near Baltimore-town, some of the purchasers have tendered the first
payment in certificates issued by the commissioner appointed to settle
the accounts
of the state troops, and it was the evident intention of the assembly,
that the first
payment should be in specie only, and the property would have sold for
a much
greater price, if the bidders and others had been informed or believed
that such
certificates would have been received in payment; |
