same respectively, and what nuisances or obstructions be found in such
road,
causeways, bridges, ditches, water-courses or drains; and every person
appointed
shall accept such office under the penalty of twenty pounds current money,
unless
excused for good and sufficient cause by the said commissioners; and for
every neglect of duty such surveyor shall forfeit not exceeding twenty
pounds
current money; and the said commissioners may make such reasonable allowance
to each of the said surveyors for their trouble as they may think proper. |
Three shillings
and
nine-pence to
be imposed,
&c. |
XVI. And,
as a fund to pay the damages sustained by individuals by the
laying out the several roads aforesaid, and to defray the other expences
incurred
in the execution of this act, Be it enacted,
That the sum of three shillings and
nine-pence current money, shall be and hereby is laid and imposed for every
hundred
pounds worth of property within Baltimore county, and in the said proportion
for every greater or less sum, and the said tax shall be paid and collected
with the county tax for this present year, and in the same manner, and
the collector
shall pay the amount of the said tax by him collected, after deducting
five
per cent. for his trouble, to such person as the commissioners of
review shall appoint
to receive the same, who shall, from time to time, pay the same to their
order. |
Gate and
turnpike to be
set up, &c. |
XVII. And,
as a fund to make and complete the said roads in manner above
directed, Be it enacted, That the
said commissioners of review may, as soon as
possible, cause to be set up and erected one gate and turnpike on such
of the said
roads leading out of Baltimore-town as they may think proper, and may
impose
such tolls as they may think reasonable, not exceeding, for every coach,
or other
four-wheeled riding carriage, and the driver and horses thereof, eight-pence
current
money; for every two-wheeled riding carriage, and the driver and horses
thereof, six pence; for every waggon and other carriage, and the driver
and
horses thereof, eight-pence; and for every horse and rider two-pence; and
such
tolls for going out of, or coming into, the sid town, shall only be paid
at the
same turnpike once in the space of twenty-four hours, and at other turnpikes
toll shall only be paid at the same turnpike once in the space of twelve
hours. |

may
think proper,
&c. |
XVIII. And be
it enacted, That the said commissioners of review may cause
to be set up and erected such number of gates or turnpikes across the said
roads
at such places as they may think proper, and may impose such tolls as they
may
think reasonable, not exceeding for waggons and other carriages, and their
drivers and horses, the sum of two-pence current money per mile, and not
exceeding
for coaches, or other four-wheeled riding carriages, and their drivers
and
horses, three-pence per mile, and not exceeding for two-wheeled riding
carriages
and their drivers and horses, two-pence per mile, and not exceeding for
any other
carriage, with the driver and horse, one penny per mile, and for each horse
and
rider, not exceeding three-pence, on passing such gates or turnpikes;
provided,
that the said tolls shall not be laid only on such part of the said roads
as shall
be made and completed in the manner herein before directed; and provided,
that
any toll for going out of, or coming into Baltimore-town, shall only be
paid at
the same turnpike once in the space of twenty-four hours. |
Persons to be
appointed to
collect tolls,
&c. |
XIX. And be
it enacted, That the said commissioners of review shall appoint
some fit person or persons to collect and receive the tolls aforesaid,
and to see that
the gates and turnpikes are duly repaired, and may from time to time remove
such
persons as they shall see occasion, and appoint others in case of death
or such removal;
and the person or persons so appointed to receive the tolls aforesaid,
shall
account before the said commissioners, or such person as they shall appoint,
in the
months of April and October yearly, or oftener if required, upon oath or
affirmation,
for the monies which they shall receive by virtue of this act; and
the
said commissioners may, out of the money arising as aforesaid, make allowance
to such persons for their care and trouble in the execution of their office
as to
them shall seem proper, always taking bond with good and sufficient security
from the persons appointed for the due and faithful execution of their
office and
rendering such account; and in case any such collector shall refuse to
account |
