Art. 35.
The position of councilman of Snow Hill held to be an "office of profit"
within the meaning of this article. The acceptance of this office vacates
the office of supervisor of elections held by the same person, and a subse-
quent resignation from the former does not restore such person to the
office of supervisor. Truitt v. Collins, 122 Md. 527. And see State Tax
Commission v. Harrington, 126 Md. 162.
The act of 1910, chapter 180 (establishing the public service commis-
sion), creates one indivisible office, and does not violate this article. See
notes to article 23, section 414 of the code. Thrift v. Laird, 125 Md. 60.
Art. 36.
An ordinance of the City of Baltimore of 1827, in so far as it prohibits
the playing of baseball on Sunday in said city, held not to violate this,
article. Hiller v. State, 124 Md. 388.

ARTICLE I.
ELECTIVE FRANCHISE.
Sec. 1.
See notes to article 33, section 12 of the code.
Sec. 1A. The General Assembly of Maryland shall have power to
provide by .suitable enactment for voting by qualified voters of the
State of Maryland who are absent and engaged in the Military or
Naval Service of the United States at the time of any election from, the
ward or election district in which they are entitled to vote, and for the
manner in which and the time and place at which such absent voters
may vote, and for the canvass and return of their votes.+

+This amendment to the constitution was proposed by the act of 1918, chapter
20, and is here printed as a matter of convenience, although at this time (May,
1918) it has not been ratified by the people and hence is not a part of the con-
stitution. The people will vote on this amendment at the election to be held in
the autumn of 1918.
