CARROLL COUNTY. 1913

nance; or, in event said ordinance omits to prescribe the fine or time,
may impose a fine not exceeding one hundred dollars, and in default of
its payment may commit for a period not exceeding sixty days, or may
impose both fine and imprisonment, in his discretion. And the sheriff
of said county shall receive and confine the person so committed in the
same manner as other prisoners; provided, that any person so fined or
committed to jail shall have the right to take an appeal to the Circuit
Court for Carroll County within ten days from the date of trial; and
may, upon entering into his recognizance with sufficient security, be
released from legal custody.

Turnpike.

1910, ch. 341, sec. 240 (p. 699)

550. The said Mayor and Common Council is authorized and em-
powered to agree and contract with the president and managers of the
Baltimore and Reisterstown Turnpike Company for the use and control
or purchase of so much of the road of said turnpike company as passes
through Westminster, or as much thereof as may be desired, upon such
terms and conditions as may be mutually agreed to by and between the
parties aforesaid, for use as a public highway.

551. The non-use or failure to execute any of the rights and privi-
leges hereby conferred upon the Mayor and Common Council of West-
minster, shall work no forfeiture thereof.

552. Nothing in this Act contained shall be construed to in any man-
ner affect or invalidate any contract or franchise entered into or granted
by the Mayor and Common Council of Westminster now in force, or any
Act passed at this session of the Legislature authorizing the issuing of
bonds or the borrowing of money.

ROAD TAXES.

1890, ch. 508.

553. It shall be the duty of the County Commissioners of Carroll
County to pay annually to the Mayor and Common Council of West-
minster, one-half of the amount of taxes levied and collected annually
by said County Commissioners for road purposes, upon the assessable
property liable to taxation within the limits of the city of Westminster, to
be appropriated and used by the said Mayor and Common Council of West-
minster, for the repair, maintenance and improvement of the streets and
roads within the limits of said city.
