9. The bailiff before entering upon the performance of his duties shall
take the same oath of office as the members of the council, and shall exe-
cute a bond in such condition and in such amount as may be prescribed
by the Mayor and council with sureties to be approved by the Mayor and
council for the faithful performance of his duties. He shall perform the
police duties of the town and is clothed with the same power as a constable
under the general laws of the State of Maryland; he shall promptly
arrest all violators of the ordinances of the town and bring them before
the proper officers to be dealt with according to law, and shall promptly
collect and pay over to the clerk all taxes and other claims of said town
which may come into his hands.

10. The assessor or assessors shall be appointed from among the citi-
zens of said town qualified to vote in said corporation, and before he or
they shall proceed to act he or they shall take an oath before a Justice of
the Peace of Garrett County that he or they will assess the value of the
assessable property of every sort within said town at its full cash value
without favor, partiality or prejudice to the best of his or their skill and
judgment; he or they shall enter and record in a book to be provided for
that purpose an accurate and fair account of all properties, stocks and
private securities of every sort within said town liable to assessment and
the valuation thereof together with a list of the owners thereof which shall
be returned by him or them to the said council on or before the third Mon-
day in June of each and every year, and which any person interested may
inspect without charge, and if anyone shall feel aggrieved on account of
valuation or assessment of his property by the said assessor or assessors
he may appeal from such valuation to the said council within four weeks
from the return of said assessment, and upon good cause being shown the
said council may make an alteration in said assessment which they may
deem proper and right and take from and add to the same; and for the
purpose of hearing and determining appeals provided for in this section
the said council shall give five days' previous notice of the time and place
of hearing such appeals by advertisement to be posted in two public places
in said town.

11. The tax lists shall be prepared by the clerk and delivered to the
bailiff on or before the first day of August in each year. The warrant
shall be in substance as follows, to wit: "The Mayor and Council of Acci-
dent, .............. Bailiff. You are hereby commanded to proceed
according to law to collect and pay over the taxes hereinafter specified.
"Witness the corporate seal of the Mayor and Council of Accident.
By the Mayor and Clerk. Attest: .............. Clerk...........
Mayor."
