1904.] OF THE SENATE. 5
election of State Senator from Cal vert county, as made
out and certified to the Governor of the State, are in-
accurate and erroneous, and do not represent the true
and legal vote cast for State Senator in Calvert county,
and that a proper and legal return of the vote cast
would show a plurality for your memorialist and
assigns therefor the following reasons, viz.:
(a) That Calvert county is divided into three elec-
tion districts, viz.: The first, second and third, and
the First District is divided into two precincts, the
first or Solomon's Precinct, and the second or Saint
Leonard's Precinct, making in all four voting places.

First District, the returns as made out by the election
officers, show a vote of one hundred and eight (108)

vote for the said Griffith should have been less than
one hundred and eight and the vote for your memor-

Second Precinct of the said First District was alto-

irregularities and illegal acts, as will be fully shown
by the evidence to be submitted, the ballots there cast
should not have been counted and, if counted, the re-

election, and should not have been made up in the re-
turns certified to the Governor of the State, and should
now be totally disregarded.
(d) That in the Third Election District a large
number of illegal ballots were counted for the said
Griffith, the exact number of which your memorialist
has been unable to ascertain, and a large number of
legal ballots were rejected and not counted which
should have been counted for your memorialist, the
