excluding the same, to its intersection with Double Pipe
creek, thence with the creek last mentioned, but excluding
its water to its intersection with little Pipe creek, thence
with the creek last mentioned, but excluding its water to
its intersection with [Sam's creek, thence with Sam's
creek,] but excluding its water to a Mill generally known
by McKinstry's Mill, including said Mill, and thence with

a straight line, to the place of beginning at Parr's Spring
aforesaid; shall be erected into a new county, by the name
of Carroll county, and that the seat of justice thereof, be
established at Westminster, and the county surveyor of
Baltimore county, or his deputy shall at least one month
before the next October election, run as herein intended
the eastern parallel line of the new county, or in the event
of their indisposition, the county surveyor of Frederick
county, or his deputy shall run said line, upon the applica-
tion of at least twenty of the residents of the said con-
templated new county, and at their expense.

Sec. 2. And be it enacted, That the inhabitants of Car-
roll county shall have, hold and enjoy, all such rights and
privileges as are held and enjoyed by the inhabitants of
any county of this state.

Sec. 3. And be it enacted, That the taxes which shall be
levied by the commissioners of Baltimore county, prior to
the confirmation of this act, or such parts of Baltimore county
as are to constitute a part of Carroll county, shall be col-
lected and paid to the treasurer of Baltimore county; and
the same be applied, precisely, as if this act had not been
passed; and that the taxes which shall be levied by the
justices of the Levy court of Frederick county, prior to the
confirmation of this act, on such parts of Frederick coun-
ty, as are to constitute a part of Carroll county, shall be
paid to the collector of Frederick county, and the same be
applied precisely as if this act had not been passed.

pleadings, which shall be depending in Frederick county
court, or in Baltimore county court, when this act shall be

Sec. 5. And be. it enacted, That the county of Carroll
shall be a part of the third judicial district of this State,

shall be the judges of the county court of Carroll county,
and the said county court shall be held as may be directed
