        Reasons in Arrest of Judgment

First Judgment Should not be given for the ^s.d^ Lord Prop.ry because
that it appears by the Information afd and verd.t that the fees Charged
is out of the Jurisdicion of this Court and in any other Colony
    2    the Verd.t afd and Information disagree
          lastly the Information is Defective in Substance

    And thereupon the Same Cause was Continued untill the third tuesday in
August then next ensuing and untill the Court Shall thereon further
advise &c.a

    And now here at the afd third tuesday in August being the twenty first
day of Said Month Anno Dom. One thousand Seven hundred thirty three
Came the afd Charles Smith by Joshua George his attorney and the afd
Lord prop.ry by his att.ry afd And the Court being fully advised as and
upon the premisses afd Do adjudge the Reasons afd in Arrest of
Judgment Insufficient to Stay or delay Judgment on the Verdict of
the Jurors afd        Therefore it is Considered by the Justices here
to wit at Kent County at the Court house in the Town of Chester in Said
County on the third tuesday in August being the twenty first day of Said
Month Anno Dom. One Thousand Seven hundred thirty and three that
the afd Charles Smith  The Right honourable the Lord proprietary
Recover against the afd Charles Smith the Sum of five Thousand pounds
of Tobacco Debt According to the force form and Effect of the Verdict
of the Jurors afd    And the Said Defendant in mercy &c.a

    And the afd Deft by Joshua George his attorney prays an
Appeal from the afd Judgment into the next prov.ll Court

    There being Several Recognizances taken by the Justices of this
County returnable to this Court upon which the Court thinks it Convenient
to have a grand Jury  Upon which Ordered by the Court that the
Clark of this Court make a Vencry to the Sherrif of Kent County to
command a Grand Jury and make return thereof to the Court here Immediately
Upon which afterwards came John Gresham Gentl. Sherrif of Said
County and made return of the Vencry afd and the pannel thereof
was endorsed as foll. viz.t
