CXCIX.

same time when the appeal was prayed for and allowed in the case aforesaid of Lockerman against
the said Thompson, and the record transmitted accordingly, any law to the contrary notwithstanding.

CHAP. CC.

An ACT authorising appropriations for the Penitentiary of this State:

BE IT ENACTED, by the General Assembly of Maryland? That the governor and council shall be and
they are hereby authorised, from time to time, to draw orders on the treasurer of the western
shore for the amount of any stock of raw materials, provisions, Working tools and implements, to be
used for the purpose of employing the criminals confined in the penitentiary of this state, not ex-
ceeding two thousand dollars tor one year ensuing the commencement of the operation of the act,
entitled, An act concerning crimes and punishments, and also for the amount of any physician's ac-
count, who may be called in to attend on the offenders confined therein, which the keeper and in-
spectors thereof snail report to the said governor and council to be necessary and proper, provided
the governor and council shall deem such report or account to be reasonable and just; which orders
the said treasurer is hereby required to pay out of any unappropriated money in the. treasury.

II. AND BE IT ENACTED, That the keeper of the penitentiary house of this state shall receive,
as a salary for his services, the sum of five hundred dollars annually, to be paid by the treasurer of
the western shore in quarter yearly payments, out of any unappropriated money in the treasury.

III. AND BE IT ENACTED, That each assistant-keeper of the said penitentiary-house, not ex-
ceeding five in number, shall receive as a salary for his services the sum of two hundred dollars an-
nually, to be paid in quarter yearly payments, out of any unappropriated money in the treasury,

IV. AND BE IT ENACTED, That this act, and every part thereof, be and the same is hereby sus-
pended until the commencement of an act passed at this present session, entitled, An act concerning
crimes and punishments, when the same shall commence and be in full force and operation, and shall
continue for one year next thereafter, and until the end of the next session of assembly.

CHAP. CCI.

Jan. 1810.

An ACT to authorise a Lottery to raise a sum of Money for building
a Church for the use of St. Margaret's Westminster Parish, in
Anne-Arundel County.

BE IT ENACTED, by the General Assembly of Maryland, That Horatio Ridout, James Mackubin, John
Maccubbin, Baruch Fowler, James P. Soper, Zachariah Jacob and Charles Stewart, be and they
are hereby authorised and appointed commissioners, to propose a scheme of a lottery for raising a
sum of money, not exceeding the sum of five thousand dollars, and to dispose of the tickets thereof;
provided the said Horatio Ridout, James Mackubin, John Maccubbin, Baruch Fowler, James P.
Soper, Zachariah Jacob and Charles Stewart, or such a majority of them as shall undertake to act
under this law, shall, before the sale or disposal of any ticket or tickets in said lottery, give bond
to the state of Maryland, in the penalty of ten thousand dollars, conditioned, that they will well
and truly apply so much of the money arising therefrom, within six months alter drawing said lotte-
ry shall commence, as will satisfy the fortunate adventurers for prizes drawn by them, and after
deducting the necessary expenses incurred in said lottery, shall, within twelve months from the time
the drawing of said lottery shall commence, apply the money raised by said lottery to the building
of a church in St. Margaret's Westminster's parish, of Anne-Arundel county.

II. AND BE IT ENACTED, That it shall be the duty of the said commissioners, before they act as
such, to lodge the bond made and entered into as aforesaid in the office of the clerk of Anne-Arundel
county court, there to be recorded, and upon such bond, or on any office copy thereof, suit or suits
may be instituted against the obligor therein, or any of them, or their legal representatives, for any
breach or non-compliance with the conditions of the same.

CHAP. CCII.

Passed 8th of
Jan. 1810.

An ACT to authorise the Levy Court of Talbot County to employ a
suitable Person to transcribe certain Records in the Clerk's Office
of said County.

WHEREAS it hath been represented to this general assembly, that some of the land records in
the clerk's office of Talbot county are in a ruinous situation; and as it is absolutely necessary
