the department. Provided, however, that no such person
shall be retained or reinstated when there is available to
fill his position an eligible person below the age of sev-
enty (70).

Should any beneficiary be restored to active service under
the provisions of this sub-section, his retirement allowance
shall cease, he shall again become a member of the Retire-
ment System, and he shall contribute thereafter at the
same rate he paid prior to retirement. Anything in this
Article to the contrary notwithstanding, any prior service
certificate on the basis of which his service was computed
at the time of his retirement shall be restored to full force
and effect, and, in addition, upon his subsequent retirement
he shall be credited with all his services as a member.

SEC. 2. And be it further enacted, That this Act is
hereby declared to be an emergency measure and necessary
for the immediate preservation of the public health and
safety, and, having been passed by a yea and nay vote,
supported by three-fifths of all of the members elected
to each of the two Houses of the General Assembly, the
same shall take effect from the date of its passage.

CHAPTER 770.
(Senate Bill 174)

AN ACT to add two new Sections to Article 27 of the
Annotated Code of Maryland (Flack 1939 Edition), title
, "Crimes and Punishments", sub-title "Sabbath Breaking",
said new sections to be known as 573-A and 573-B, and
to follow immediately after Section 573 of said Article,
to permit the exhibition of Motion Pictures within the
corporate limits of the Town of Aberdeen, Harford
County, on Sundays, during certain hours, except to
children unaccompanied by adult members of their
families; and providing that on the 5th day of June, 1943,
the voters of the Town of Aberdeen, who are qualified
to vote in a Town election, shall by referendum vote,
decide whether the exhibition of Motion Pictures within
the corporate limits of said Town shall continue to be
permitted after June 15, 1943.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That two new Sections be, and they are hereby
