ROBERT WRIGHT, ESQUIRE, GOVERNOR. NOVEMBER. 1808.

situation of Benjamin Buckler, and if it shall appear to them reasonable and right that the said Ben-
jamin Buckler ought to be an out pensioner, and that his circumstances render his situation in the
poor-house particularly unsuitable to him, then and in that case they may allow him an annual pension,
during his residence in the said county, not exceeding thirty dollars, to be paid at such time or times

as they shall direct.

V.

A Supplement to the act, entitled, An act to extend further the
powers of the levy court of Allegany county relative to roads in
said county, and for other purposes.

Passed 20th of
Dec, 1808.

BE IT ENACTED, by the General Assembly of Maryland, That from and after the fifteenth day of
August next, no male person under the age of eighteen or over the age of sixty years, shall be
obliged to assist in repairing the public roads in Allegany county.

II. AND BE IT ENACTED, That the levy court of Allegany county shall not direct the supervisors
of the several districts in said county to warn the able-bodied male persons, or their masters or
mistresses, as the case may be, over the age or eighteen and under the age of sixty years, to work
in repairing the roads in said county more than four days in any one year.

III. AND BE IT ENACTED, That all such part of the act or acts of assembly heretofore passed,
as are contrary to the provisions of this act, be and the same are hereby repealed.

CHAP. VII.

Part of acts re-
pealed.

An ACT for the relief of James Mulvany, of Washington county.

Passed 20th of
Dec 1808.

WHEREAS James Mulvany, of. Washington county, emigrated to the state of Maryland in
seventeen hundred and eighty -four, and has ever since resided therein, and since his emigra-
tion and settlement as aforesaid, has acquired real property therein, and his title to such property,
from his not having become naturalized agreeably to the laws of Maryland, or those of the United
States, may be called in question, to his great detriment and injury; therefore,

Preamble..

U. BE IT ENACTED, by the General Assembly of Maryland, That the title of the real property of the
said James Mulvany, fully and fairly acquired heretofore, by purchase or deed, be and the same is
hereby amply and fully vested in the said James Mulvany, and his heirs, in fee-simple, to all. intents
and purposes, in the same manner that it would have been if the said James Mulvany had been duly
naturalized agreeably to said laws, at the time of his said purchase, and when be received his said
deeds; provided always, that nothing in this act contained shall in any manner defeat or affect any
right, title or claim, to the said property, or any part thereof, acquired or prosecuted by any person
or persons whatever before the passage of this act; and provided also, in case the said James Mul-
vany hath not as yet become a citizen of the United States, that unless he shall, on or before the
thirty-first day of October, which shall be in the year eighteen hundred and nine, proceed according
to law to make himself a citizen of the United States, this act shall have no effect to confirm his
title to the property above mentioned; but if the said James Mulvany die before the thirty-first day of
October, eighteen hundred and nine, nothing in this proviso contained shall prevent him from trans-
mitting or transferring his said property, by descent or devise, to any person or persons being a ci-
tizen or citizens of the United Stater, and residing therein, capable in law to hold the same.

CHAP. VIII.

Title vested,
&c.

An ACT authorising Nathaniel Rochester, late sheriff and collector
of Washington county, to complete his collection.

Passed 20th of
Dec. 1808.

BE IT ENACTED, by the General Assembly of Maryland, That Nathaniel Rochester, late sheriff and
collector of Washington county, be and he is hereby authorised to collect, until the first day
of December, eighteen hundred and nine, all balances due him as sheriff and collector of Washing-
ton county for the year eighteen hundred and six, in the same manner as he could or might have
done within the time limitted by law, any law to the contrary notwithstanding.

N. Rochester
to collect, &c.

II. AND BE IT ENACTED, That it shall be the duty of the said Nathaniel Rochester, before he
proceeds to execute or distrain the property of any person or persons for taxes, officers fees, or pub-
lic dues, in virtue of this act, to deliver to such person or persons chargeable with the same, at
least thirty days previous to levying such execution or distress, an account, written in words at full
