1808. NOVEMBER. LAWS OF MARYLAND.

CHAP.
CXVIII.

ed, to appoint fit and proper persons as trustees, in case the said William Handy and James Ritchie,
or either of them, shall die or refuse to act, and the person or persons so appointed, snail have and
possess the same powers as are vested in William Handy and James Ritchie by the act to which this
is a supplement.

CHAP. CX1X.

A Supplement to the act, entitled, An act to confirm and make
public a certain road therein mentioned.

Preamble.

WHEREAS by an act of November session, eighteen hundred and six, entitled, An act to lay
out and straighten a road from Towson's tavern, on the Baltimore turnpike road, to intersect
the Pennsylvania line at major David Wiley's, certain commissioners therein named were authorised
and required to view and lay down a correct plot of the aforesaid road: And whereas by the act to which
this is a supplement, the said commissioners were directed to return said plot to the levy courts of
Baltimore and Harford counties respectively: And whereas it is represented to this general assembly,
by the petition of sundry inhabitants of Baltimore and Harford counties, that they labour under
great inconvenience for want of that part of the said road that lieth between John Wise's tavern in
Harford county, and William Slade's in Baltimore county, and have prayed that a law may pass con-
firming so much of the plot of said road, returned by said commissioners, as lieth between the said
John Wise's and William Slade's as aforesaid, may be confirmed; therefore,

Plot confirmed,
&c.

II. BE IT ENACTED, by the General Assembly of Maryland, That the plot and survey of the said
road, returned by the commissioners aforesaid, so far as the same may he between John Wise's in
Harford county, and William Slade's in Baltimore county, be and the same is hereby confirmed, and
the said road is hereby declared to be a public road, and shall be kept in repair as other public roads
in said counties are kept in repair; and the levy courts of Baltimore and Harford counties are here-
by empowered and directed to assess and levy a sum, such as in their opinion will be sufficient to clear
and open said road, so far as the same may run in either county, and to appoint an overseer or
overseers to open said road,

III. AND BE IT ENACTED, That the overseer or overseers appointed by either of the levy courts
upon or over said road, shall be entitled to the came allowance for their services as other overseers
in said counties respectively may be entitled to.

CHAP. CXX.

Preamble.

An ACT to lay out and open a road in Anne-Arundel county.

WHEREAS application has been made to the general assembly, by sundry inhabitants of the
county aforesaid, representing that they suffer great inconveniencies for want of a load from
John Crow's mill, on Patuxent river, to intersect the road leading from Montgomery county court-
house to the city of Baltimore, at the widow Pue's lane, near Ely Davis's; that nearly all the pro-
prietors of the land through which the said road is intended to pass, are desirous that the said road
should be made the distance, being about eight miles, and have prayed that a road might be laid out
and opened, of the width of forty feet, at the expense of those who are willing to contribute thereto;
and the general assembly apprehending the prayer of the petitioners reasonable, therefore,

II. BE IT ENACTED, by the General Assembly of Maryland, That Henry Griffith, Brice Gassaway
and Thomas Worthington, of Nicholas, are hereby appointed commissioners, and they, or any two
of them, are hereby authorised to survey, lay out and open, a road, at the expense and proper cost
of them who are willing to contribute to the same, forty feet wide, from a point which may be most
convenient to cross Patuxent river near John Crow's mill, to intersect the road leading from Mont-
gomery county court-house to the city of Baltimore, at the widow Puers lane, and near Ely Davis's;
and the said road, when so surveyed, laid out and opened, and the valuation herein after directed to
be made shall have taken place, shall be recorded in Anne-Arundel county court, and shall be deemed
and taken to be a public road for ever thereafter, and kept in repair as other public roads are in said
county.

Damages to be
ascertained,

&c.

III. AND BE IT ENACTED, That the said commissioners shall ascertain and value what damages
may be sustained by any person or persons through whose land the said road shall pass, and the same,
when so assessed, shall be paid, or secured to be paid, by the contributors, before the said commis-
sioners shall proceed to open the said road; provided always, that if any person or persons, through
whose land the said road shall pass, or his, her or their guardian or trustee, shall conceive themselves
aggrieved by such valuation and assessment of damages by the said commissioners, it shall and may
