CHAP. 332.

said inquest shall be returned to the clerk of said coun-
ty, to be by him recorded at the expense of said com-
pany, and the valuation expressed in said inquisition
shall be paid by said president and directors to the
owners of said property so valued, or his legal repre-
sentative before said president and directors shall, pro-
ceed to use the same.

Penalty for
obstructing.

SEC. 9. And be it enacted, That if any person shall
alter or change or in any manner obstruct or encroach
on the said road or any part thereof, or cut down and
destroy any turnpike gate, or cut down, destroy, deface
or remove any mile stones set upon said road, or put or
place any rubbish, dirt, logs, stones or any other obstruc-
tion in said road, or make any pit or hole therein, such
person may be indicted in Allegany county court, and
being thereof convicted, shall be fined or imprisoned in
the discretion of the court, according to the nature of the
offence, and the president and directors shall cause any
obstructions or nuisances on the said road to be removed,
and shall restate the same to its proper state and con-
dition.

To report to
Governor as
soon as road is
completed.

SEC. 10. And be it enacted, That as soon as the road
shall be completed in the manner directed by this act,
the president and directors shall forthwith transmit to
the Governor a full and lair account of the cost of said
road and the amount of tolls received previous to its
completion, and shall annually thereafter transmit to the
Governor a yearly account of the tolls received and of the
expenses incurred on said road.

To erect toll

gates and to
charge toll.

SEC. 11. And be it enacted, That the said president
and directors may erect or cause to be erected one toll
gate on said turnpike for every three miles and a halt of
said road that may be completed as herein directed, and
may charge, take, collect and receive for passing any one
of said, gates for every coach or other four wheeled
riding carriage, the driver, passengers and horses, not
exceeding eight cents; for every wagon or other carriage
of burthen drawn by horses, mules or oxen, not exceed-
ing two cents per horse, mule or ox; for every horse and
rider not exceeding three cents; lor every single horse,
camel, ass or mule not exceeding one cent; and for
black cattle not exceeding one-half cent; for every score
of sheep or hogs at the rate of five cents the score.

Rights vested.

SEC. 12. And be it enacted, That the said road and
tolls shall he and are hereby vested in the said corpora-
tion and their successors forever.

SEC. 13. And be it enacted, That if any person shall
