ing ten fhillings, to be afcertained and allowed by the juftices aforcfaid at their
levy court annually, until the faid prifon fhall be completed, to be levied on the
county, and collected as other public dues.

CHAP.

IV.

VII. And be it enacted, That the faid commiffioners, or a majority of them,
fhall be and they are hereby inverted with full power and authority to apply the
faid money, to be levied and collected as aforefaid, either for the purpofe of re-
pairing the old gaol in the county aforcfaid, or building a new one agreeably to
the directions of this act, as they in their judgment fhall think proper.

VIII. And be it enacted, That if any of the faid commiffioners fhall die, re-
move out of the county, or refufe to act, the refidue, or a majority of them,
fhall immediately thereafter proceed to nominate and appoint another to fill up
the vacancy.

CHAP. V.
An ACT to empower Micajah Merryman, father and guardian of
Sarah Merryman, Mofes Merryman, Eleanor Merryman, Mary
Merryman and Micajah Merryman, infants, to demife the real
eftate therein mentioned.

WHEREAS it has been reprefented to this general affembly, by the pe-
tition of Micajah Merryman, that he intermarried with a certain Ma-
ry Enfor, of Baltimore county, and that he is poffeffed of the follow-
ing parts of lots of ground and premifes, viz. Part of lot No. fixty, part of lot
No. five, part of lot No. fix, and alfo part of lot No. fifty-five, as tenant for
life by the curtefy, which faid lots defcended to Sarah Merryman, Mofes Merry-
man, Eleanor Merryman, Mary Merryman and Micajah Merryman, the children
of the aforefaid Mary and him the faid Micajah, and that the faid parts of lots
and premifes are in the unimproved part of Baltimore-town, and that the fame
are incumbered with taxes and public dues, and that the commiffioners of the
town are about to pave the ftreets on which faid lots ftand, which would require
a large fum of money; and the faid Micajah, as guardian of the aforefaid
children, would have to pay the fame, and praying that an act might pafs,
empowering him, the faid Micajah, to demife and leafe out the aforefaid parts of
lots and premifes; and it appearing reafonable to grant the fame, therefore,

Preamble.

II. Be it enacted, by the General Affembly of Maryland, That it fhall and may
be lawful to and for the faid Micajah Merryman to leafe and demife fuch
parts of the aforefaid lots as he fhall think proper, to fuch perfon or perfons, for
fuch term or terms of years, with fuch covenants, claufes and provifoes inferted,
for the renewrnent of fuch leafes from time to time, for ever, if the fame fhall be
agreed upon, with fuch other covenants, claufes and provifoes, as are ufual and
cuftomary in leafes made of lots in the unimproved parts of Baltimore-town;
which faid leafes fhall be made in the name of the faid Micajah Merryman, and
his children aforefaid, and the rents agreed on to be referved and payable to the
faid Micajah Merryman, his executors, adminiftrators and affigns, for the ufe
and benefit of the aforefaid Sarah Merryman, Mofes Merryman, Eleanor Merry-
man, Mary Merryman and Micajah Merryman, and after they fhall feverally ar-
rive at the age of twenty-one years, their refpective proportions of the rents fo
referved fhall be payable to them refpectively, their refpective heirs and afligns,
for ever, and the term limitted to fuch leffees fhall be as good and valid, to all
intents and purpofes, as if they, the faid Sarah Merryman, Mofes Merryman,
Eleanor Merryman, Mary Merryman and Micajah Merryman, had been or full
age to execute the fame; provided, that the faid leafes fhall not burthen the faid
Sarah Merryman, Mofes Merryman, Eleanor Merryman, Mary Merryman and
Micajah Merryman, with any covenants or affurances for quiet enjoyment of the
premifes, other than from and againft themfelves, and ail perfons claiming by,
from or under them.
