1798.

VIII. AND BE IT ENACTED, That if the faid Peter Redhead fhall be arrefted or imprifoned on
any procefs fued out on any judgment or decree obtained againft him for any debt, damages or
cofts, contracted, owing, or growing due before the paffing of this act, the court out of which
fuch procefs iffued fhall and may discharge the faid Peter Redhead on motion; and if the faid
Peter Redhead fhall be arrefted or imprifoned on any procefs for the recovery of any debt, da-
mages or cofts, contracted, owing, or growing due before the paffing of this act, the court before
whom fuch procefs fhall be returnable fhall and may difcharge the faid Peter Redhead out of cuf-
tody on his common appearance being entered, without any fpecial bail; provided, that the dif-
charge of the faid Peter Redhead fhall not acquit any other perfon from fuch debt, damages or
cofts, or, any part thereof, but that all fuch perfons fhall be anfwerable for the fame in fuch man-
ner as they were before the paffing of this act.

C H A P.
CIX.

If arrefted, to

be difcharged,
&c.

IX. AND BE IT ENACTED, That if any creditor of the faid Peter Redhead, at any time within
two years after he is difcharged, fhall allege, in writing, to the juftices of Talbot county court,
in court fitting, that he the faid Peter Redhead hath, directly or indirectly, fold, conveyed,
leafed, or otherwife difpofed of, or intrufted or concealed, any part of his property of any kind,
or any part of his debts, rights or claims, thereby wilfully to deceive or defraud his creditors,
or any of them, or to fecure the fame, or to receive or expect any profit, benefit or advantage
thereby, the faid court may thereupon examine the faid Peter Redhead on interrogatories, on
oath, for the difcovery of his property, or any concealment thereof, and refpecting his conduct
touching the fame, or the faid juftices may, in their difcretion, direct an iffue to be tried in the
faid court to determine the truth of any allegation made by the faid Peter Redhead; and if the
faid Peter Redhead fhall be found guilty of any wilful fraud or deceit of his creditors, he fhall
for ever be precluded from having any benefit of this act; and in cafe the faid Peter Redhead
fhall, at any time within two years as aforefaid, upon any indictment, be convict of wilfully,
falfely and corruptly fwearing to any matter or thing in his oath aforefaid contained, he fhall
fuffer as in cafe of wilful and corrupt perjury, and likewife be liable to his creditors, and be
wholly deprived of any relief or benefit by this act.

C H A P. CX.
A Further fupplement to the act, entitled, An act for building a new gaol in
Baltimore county.
WHEREAS difficulties may occur in the purchafe of grounds fituated in all refpects as a
fituation for the new gaol; for remedy whereof,

II. BE IT ENACTED, by the General Affembly of Maryland, That the commiffioners named in the
original act to which this is a further iupplement, or a majority of them, or a majority of the fur-
vivors are hereby authorifed and empowered to apportion and lay off a lot or lots of ground, not
exceeding feven acres, agreeably to the location fixed in a law paffed at the prefent feffion of
affembly entitled, A fupplement to an act, entitled, An act for building a new gaol in Baltimore
county, and to agree with the owner or owners thereof for the abfolute purchafe in fee of the
faid lot or lots of ground fo laid off; and in cafe the owner or owners of fuch lot or lots of
ground, or any or the faid owners, fhall refufe to make fale of fuch lot or lots of ground for the
purpofe of building faid new gaol, at a reafonable price, or be under a difability of making fale
thereof then the faid commiffioners, or a major part of them, fhall be and are by virtue of this
act authorifed, empowered and required, to iffue their warrant to the fheriff of Baltimore coun-
ty, requiring and commanding him to empannel and return a jury of feven fubftantial freeholders
within the faid county, to be and appear before faid commiffioners at a certain day to be by them
limitted and appointed, of which notice fhall be given to the parties interred, which jury, upon
their oath, fhall inquire who is or are the owner or owners of the faid land, what is the value
thereof, and what damages fuch owner or owners will fuftain; and the fum of money the faid
jury fhall affefs to the owner or owners for fuch lot or lots of ground, and damages, fhall be paid,
or fecured to be paid, by the commiffioners aforefaid, and thereupon the county of Baltimore
fhall be inverted with a clear and abfolute eftate in fee-fimple in the faid grounds fo located as
aforefaid; and the faid commiffioners, of a majority of them, or a majority of the furvivors of
them, are hereby authorifed and empowered to employ the furveyor of Baltimore county or a
fworn deputy, to make the faid furvey, and form a certificate thereof, which faid certificate fhall
be lodged in the clerk's office of Baltimore county for fafe keeping, and recorded among the rolls
of Baltimore county, to ferve as perpetual evidence of the title of Baltimore county in and to

the faid grounds.

manner of holding elections for reprefentatives of this ftate in the congrefs of
the United States, and for appointing electors on the part of this ftate for
choofing a prefident and vice-prefident of the United States, and for he re-
gulation of the faid elections, and alfo to repeal the acts of affembly therein

mentioned.

WHEREAS the city of Baltimore conftitutes a part of the fifth diftrict of Maryland for the

vice-prefident of the United States: And whereas the commiffioners of an act paffed to inco-

porate the faid town, fuperfeded in their office, it may happen, from the death or removal of

them, that no judges fhould remain for the holding of faid elections, for remedy whereof,

II. BE IT ENACTED by the General Affembly of Maryland, That the mayor and fecond branch of

the city council of the city of Baltimore, or any three or more of them, for the time being,
