Sec. 37. And be it further enacted, That in the event any pro-
visions of any law, charter, ordinance, resolution, rules or regulation
now in force in the City of Baltimore or State of Maryland, are
inconsistent or conflict with any provisions of this Act, then in any
and all such cases, the provisions of this Act shall be controlling.

Sec. 38. And be it further enacted, That this Act shall be declared
to be an emergency measure and necessary for the immediate preser-

vation of the public health and safety, and having been passed by

a yea and nay vote, supported by three fifths of all the members

elected to each of the two Houses of the General Assembly of Mary-

land, the same shall take effect on May 1, 1961 TAKE EFFECT

(Senate Bill 337)

AN ACT to repeal and re-enact, with amendments, Sections 212 (c)
and 213 of Article 56 of the Annotated Code of Maryland (1957
Edition), title "Licenses", sub-title "Real Estate Brokers", abol-
ishing the present Real Estate Commission, and creating a new
Real Estate Commission in its place, providing generally for the
membership, powers, and duties of the Commission.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 212 (c) and 213 of Article 56 of the Annotated Code
of Maryland (1957 Edition), title "Licenses", sub-title "Real Estate
Brokers", be and they are hereby repealed and re-enacted, with
amendments, to read as follows:

212.     (c) "Commission" shall mean the [Maryland! Real Estate
Commission £.] of Maryland.

213.    [There is hereby created the Real Estate Commission of
Maryland. The Governor shall immediately appoint three persons,
one of whom and the chairman of the Commission shall be the chief
of the License Bureau of the State of Maryland, and two of whom
shall have been citizens and residents of this State for not less than
five years and whose vocation for a period of at least ten years
immediately preceding their appointment shall have been that of a
real estate broker or a real estate salesman. The chief of the License
Bureau and his successors shall serve during their respective terms
of office as such; one of the other two members shall be a resident
of Baltimore City and one a resident elsewhere in the State of Mary-
land; one shall be appointed for a term of two years and one for a
term of four years; and until their successors are appointed and
qualify, thereafter one member shall be appointed every second year
