Letter from State Law Department on H. B. 991

Dear Governor Agnew:

At your request, I have examined House Bill 991, in order to
determine whether the Bill meets minimum constitutional require-
ments as to form and legal sufficiency.

The title to the Bill indicates that the Bill authorizes and directs
the County Commissioners of Garrett County to appoint a committee
to study the establishment and scope of a proposed merit system for
County employees. The body of the Bill creates in Garrett County
such a Commission, composed of five persons, two of whom shall be
appointed by the County Commissioners, two by the Garrett County
Delegation in the House of Delegates and the State Senator represent-
ing Garrett County, and one by the Judge of the Circuit Court for
Garrett County.

In our opinion, the conflict between the title and the body of the
Bill, relative to the manner in which this Commission is to be
appointed, cannot be reconciled. Because the title does not correctly
state the manner of appointment, and because it is clearly misleading,
I am unable to approve this Bill as to form and legal sufficiency. In
my opinion, the Bill cannot be said to meet minimum constitutional
requirements.

House Bill No. 1017 Charles County—Courthouse

AN ACT to authorize and empower the County Commissioners
of Charles County to borrow upon the faith and credit of said County
an amount not exceeding One Million Five Hundred Thousand Dollars
($1,500,000), and to issue bonds therefor, for the cost of court house
repairs, alterations and/or additions and providing for the levy of
taxes in Charles County for the payment of principal and interest on
such bonds.

In accordance with Section 17 of Article II of the Maryland
Constitution, I have vetoed today House Bill 1017 and am returning
