LAWS OF MARYLAND
Special Session

June 22, 1967

MARYLAND, Set:

At a Special Session of the General Assembly of Maryland, begun
and held in the City of Annapolis, on the Twenty-second day of
June, 1967, Spiro T. Agnew, being Governor of the State, the
following laws were enacted, to wit:

CHAPTER 1
(Senate Bill 1)

AN ACT to make an emergency appropriation of funds from the
General Funds of the State for maintenance of State Government,
to wit for those programs set forth in Chapter 142, Laws of 1967
(House Bill No. 378), providing State Aid for Police Protection,
Aid to Education (increasing the appropriation to the Depart-
ment of Education over and above the items set forth in the
Budget Bill (House Bill No. 80) for the State Share of Current
Expenses, Current Expense Incentive Aid, Transportation and for
School Construction, and confirming the appropriation in the
Budget under the title "Incentive Fund for School Construction"
so that the same may be used under the provisions of Maryland
Code, Article 77, Section 222, as re-enacted in Chapter 142 of the
Laws of 1967) and State Grants to the Subdivisions in accordance
with the provisions of Maryland Code, Article 81, Section 12H as
enacted by said Chapter 142 in order to meet a certain emergency.

Whereas, Chapter 142, Laws of 1967 (House Bill No. 378) was
enacted at the Regular Session 1967 of the General Assembly which
was intended by the General Assembly to be a supplementary appro-
priation bill so that the monies therein provided to be paid and the
monies provided to be paid under the formulae therein set forth
would be made available to the political subdivisions of this State
for expenditure in the fiscal year 1967-1968; and

Whereas, in a case entitled Stanley I. Panitz, et al. v. Comptroller
of the Treasury and the State Treasurer, No. 125 Advanced Sep-
tember Term, 1967, the Court of Appeals of Maryland determined
that the said Bill was ineffective as a supplementary appropriation
measure and enjoined the Comptroller of the Treasury and the State
Treasurer from directing and making, respectively, the expenditures
