to cost approximately four million two hundred thousand dollars
($4,200,000); and

Whereas, The existing Constitutional provisions relating to the
budget of the Judicial Branch are uncertain as to the authority of
the Executive and the Legislature in making reductions in the
Judicial Budget; and

Whereas, The concept of the Judicial Budget within the Executive
budgetary system utilized by the State of Maryland needs to be
carefully analyzed and examined in light of these potential increases
in the size of the Judicial Budget; now, therefore, be it AND

WHEREAS, SERIOUS ISSUES HAVE ARISEN REGARDING
THE AUTHORITY OF THE LEGISLATURE OVER THE
BUDGETS OF THE TWO OTHER BRANCHES OF GOVERN-
MENT UNDER THE PRESENT EXECUTIVE BUDGETARY
SYSTEM; NOW, THEREFORE, BE IT

Resolved by the General Assembly of Maryland, That the Legisla-
tive Council is requested to undertake a study of the Constitutional
provisions relating to the budget of the Judiciary Branch BUDGET-
ARY PROCESS in Maryland and to report its findings and recom-
mendations to the 1972 General Assembly.
