Resolution of the

Mayor and Aldermen of the City of Annapolis
to Amend the City Charter

Resolution of the Mayor and Aldermen of the City of Annapolis,
adopted pursuant to the authority contained in Article 11-E of the
Constitution of the State of Maryland and Article 23-A of the Anno-
tated Code of Maryland (1966 Replacement Volume), to repeal and
re-enact, with amendments, Section 30-A of the Charter of the City
of Annapolis titled "Additional Allowance to Certain Retired Em-
ployees," to provide for an increase in allowances to certain retired
employees.

SECTION I. BE IT RESOLVED by the Mayor and Aldermen of the
City of Annapolis that Section 30-A of the Charter of the City of An-
napolis be, and the same is hereby, repealed and re-enacted to read as
follows:

Section 30-A. Additional allowance to certain retired employees.

Any employee of the City of Annapolis who shall retire and who shall
receive by reason of his prior city employment any retirement allowance
under the provisions of Article 73-B, titled "Pensions" of the Annotated
Code of Maryland (1970 Replacement Volume), shall be paid an additional
sum by the Mayor and Aldermen of the City of Annapolis that, when added
to whatever sum any such person is receiving from the Employees' Re-
tirement System of the State of Maryland, shall be equivalent to 2% of his
annual salary (as of the date of his retirement) for each year of continuous
service, or fraction thereof, upon application to the Mayor and Aldermen
of the City of Annapolis. The supplement payment thus allowed shall in
no case exceed $200 per month. Said Mayor and Aldermen shall annually
levy an amount sufficient to pay such additional allowance as established
under this section. The provisions of this section shall not apply unless
such employee has been employed by the said City for a period of ten (10)
years and has been a participant in the Employees' Retirement Sys-
tem of the State of Maryland continuously during such period of employ-
ment. Further, the provisions of this section shall not apply to those persons
who are recipients of supplemental payments from the Mayor and Alder-
men prior to the effective date of this amendment but that the previously
retired persons who are receiving supplemental payments prior to the
adoption of this resolution shall continue to receive the additional allow-
ance as provided by Section 30-A of the Charter of the City of Annapolis
which was in effect just prior to the effective date of this Charter Amend-
ment. A copy of said allowances shall be kept on file in the Office of the
Collector and Treasurer. The provisions of Section 29 of Article 73-B of
the Annotated Code of Maryland (1970 Replacement Volume) shall not
apply or govern this section.

SECTION II. AND BE IT FURTHER RESOLVED by the Mayor
and Aldermen of the City of Annapolis that the date of adoption of this
Resolution is the 14th day of June, 1971, and the Amendment of the
Charter of the City of Annapolis hereby enacted shall become effective on
the fiftieth day after its passage, unless a proper petition for referendum
hereon shall be filed as permitted by law; provided a complete and exact
