AN ACT concerning

Secretary of Personnel — Appeals Concerning
Extension of leave

FOR the purpose of permitting certain incapacitated State
employees to appeal to the Secretary of Personnel,
rather than to the Board of Public Works, for
extensions of leave with pay; and clarifying language.

BY repealing and reenacting, with amendments,

Article 64A - Merit System

Section 37(e)

Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

Article 64A — Merit System

37.

(e) [In case] IF any employee who has been in the
State service for not less than ten years [shall suffer]
SUFFERS an illness or injury which would result in his
absence from duty for a period of time exceeding that
provided in subsection (a) with pay, [such] THAT employee
[may], with the approval of the head of the department or
agency of the State in which he is employed, MAY appeal to
the [Board of Public Works] SECRETARY OF PERSONNEL for an
extension of leave with pay[; and the Board]. THE
SECRETARY, after being satisfied as to the merits of the
case, may authorize an extension of leave with pay[,
provided that such extension of time shall not exceed] UP TO
one year, including the leave allowed under subsection (a).

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1978.
