BY adding to

Article 81 - Revenue and Taxes

Section 288A

Annotated Code of Maryland

(1975 Replacement Volume and 1979 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed amended, or enacted to read as follows:

Article - Transportation

SUBTITLE 4. TRANSPORTATION REVENUE SHARING FUND

3-401.

(A)  THERE IS A TRANSPORTATION REVENUE SHARING ACCOUNT
IN THE TRANSPORTATION TRUST FUND.

(B)  THE FOLLOWING REVENUES SHALL BE CREDITED TO THE
TRANSPORTATION REVENUE SHARING ACCOUNT:

(1)  20 PERCENT OF THE VEHICLE TITLING TAX; AND

(2) THE REVENUE PRODUCED BY 2 PERCENT OF THE NET
CORPORATE INCOME ALLOCABLE TO THE STATE UNDER § 316 OF
ARTICLE 81.

(2)  THE REVENUE DISBURSED TO THIS ACCOUNT UNDER
§ 288A OF ARTICLE 81.

(C)  DURING EACH FISCAL YEAR, THE ACCOUNT SHALL BE
DISTRIBUTED AS FOLLOWS:

(1)  75 PERCENT OF THE FUND SHALL BE CREDITED TO
THE TRANSPORTATION TRUST FUND FOR THE ACCOUNT OF THE
DEPARTMENT;

(2)  EVERY COUNTY WHICH HAS LESS THAN 1 PERCENT
OF THE TOTAL POPULATION OF THE STATE, AS DETERMINED BY THE
SECRETARY OF TRANSPORTATION DEPARTMENT OF HEALTH AND MENTAL
HYGIENE, SHALL RECEIVE 1 PERCENT OF THE BALANCE OF THE
REVENUES IN THE FUND; AND

(3)  THE REMAINING FUNDS SHALL BE DIVIDED AMONG
BALTIMORE CITY AND THE REMAINING COUNTIES PROPORTIONALLY ON
A POPULATION BASIS. THE BASIS OF THEIR POPULATION AS OF JULY
1 OF THE YEAR OF THE GRANT AS DETERMINED BY THE DEPARTMENT
OF HEALTH AND MENTAL HYGIENE.

(D)  THOSE FUNDS SO DISTRIBUTED TO BALTIMORE CITY AND
THE COUNTIES UNDER (C)2 AND (C)3 OF THIS SECTION MAY BE USED
FOR TRANSPORTATION RELATED PROJECTS OR OTHER PURPOSES AS
DETERMINED BY THE APPROPRIATE LOCAL GOVERNMENT.
