(i) The public health and safety is endangered
after a natural disaster or act of God;

(ii) A state of emergency is declared by the
Governor; or

(iii) A bona fide single source of supply or a
proprietary product or process is required; or

(iv) [Its] THE Board determines it is in the
best interests of this State.

Each waiver and the reasons therefor shall be
documented and recorded and immediately reported to the
Maryland Register for printing in the next available issue.

SECTION 2. AND BE IT FURTHER ENACTED, That if any
provision of this Act or the application thereof to any
person or circumstance is held invalid for any reason in a
court of competent jurisdiction, the invalidity does not
affect other provisions or any other application of this Act
which can be given effect without the invalid provisions or
application, and for this purpose the provisions of this Act
are declared severable.

SECTION 2 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1979.

Passed over the Governor's veto, in the Senate on January 9,
1980, and in the House of Delegates on January 10,
1980.

AN ACT concerning

The Board of Public Works - Leases
Subject to Board Approval

FOR the purpose of providing that the requirement that the
Secretary of the Department of General Services shall
submit all proposals for leases for office or building
space rental to the Board of Public Works for final
approval shall not apply if Board of Public Works
regulations provide otherwise; providing that the Board
of Public Works may adopt regulations, subject to
approval by the General Assembly or by a certain
Committee, by which State departments, boards,
commissions, or other agencies may enter into land,
building, or facility space leases or lease renewals
prior to or without Board of Public Works approval
