and necessity shall prepare a recommendation in connection
with the registration or permit required by this section.
Such recommendation shall be presented at the hearing
required under Article 78, § 54A, of the Annotated Code of
Maryland. The decision of the Public Service Commission in
connection with the registration or permit shall be binding
on the Secretary of Health and Mental Hygiene, subject to
judicial review as set forth in the provisions of Article
78, § 91, subsection (a).
SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1980.

AN ACT concerning
Health - Clinical Laboratories
FOR the purpose of enabling the Secretary of Health and
Mental Hygiene to enter into agreements with approved
organizations to conduct the periodic inspection of
laboratories and tissue banks; and providing that the
proficiency testing program shall be conducted by the
Department or an organization approved by the
Secretary.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
be repealed, amended, or enacted to read as follows:

(a) The Secretary of Health and Mental Hygiene shall
establish the minimum standards and qualifications for any
laboratories and tissue banks in the counties of the State
and in Baltimore City which make examinations in connection
with the diagnosis and control of human diseases, or which
